exist or as amended. Such expenses include, but are not limited to the following: air travel; taxi <br /> and auto rental; lodging; meals; memberships and subscriptions to publications of the <br /> International City Management Association and the Illinois City Management Association; <br /> registration fees for training programs offered by such associations; and travel and incidental <br /> costs relating to attendance at such training programs or conferences and meetings of such <br /> associations. It is specifically understood that the above membership and participation in <br /> training, conference and meetings are to be undertaken by Employee, at his request and at the <br /> approval and/or request of the City Council, and shall be considered as part of the duties and <br /> responsibilities of Employee hereunder. Employee shall be reimbursed for other reasonable <br /> expenses as the City shall approve by lawful action of the City Council. <br /> 11. GROUP INSURANCE BENEFITS. The City, subject to the limitation provided <br /> for herein, shall continue to provide Employee with group life insurance and employee and <br /> dependent health, hospitalization and dental coverage equal to such insurance or benefits <br /> provided other management employees of the City. Notwithstanding the foregoing, it is agreed <br /> and understood that the City may, at its sole option, modify, or eliminate said insurance or <br /> benefits, or any portions thereof, provided that Employee is treated no differently than other <br /> management employees of the City. <br /> 12. HOLIDAYS. Employee shall receive the same paid holidays which are afforded <br /> to other management employees of the City. <br /> 13. DISABILITY. If Employee is unable to perform all of his duties and <br /> responsibilities essential to his position of Interim City Manager, as determined by the City <br /> Council, because of sickness, accident, injury, mental incapacity or ill health(herein <br /> "Disability"), he shall be eligible for"Disability Leave" after exhausting all accrued sick leave <br /> and vacation leave. Disability Leave shall be unpaid and may be approved by the City for a <br /> period of up to six (6) months. Disability Leave shall be dependent upon the length of disability <br /> as demonstrated by Employee. To determine Disability, the City shall have the right to have a <br /> medical examination(s) of Employee made at a reasonable time(s) by a physician selected by <br /> City. If Employee is unable to return to work at the end of a Disability Leave, City shall have <br /> the option to terminate the employment of Employee subject to requirements imposed in Section <br /> 16(b) of this Agreement. <br /> 14. ELIGIBILITY OF BENEFITS AFFORDED OTHER MANAGEMENT <br /> EMPLOYEES OF THE CITY. Except for the provisions of Sections 6 through 13 above, <br /> Employee shall receive the same employment benefits which are provided to their management <br /> employees of the City. <br /> 15. PUBLIC OFFICIAL LIABILITY INSURANCE AND REPRESENTATION BY <br /> LEGAL COUNSEL. The City shall provide Employee with public official liability insurance in <br /> accordance with such provided for other officers of the City. In addition, if the Employee is <br /> named or made a party to any action, claim, or demand (collectively, herein"Claim"), except for <br /> criminal,traffic, misdemeanor, or petty offenses, which arise from his actions or conduct as an <br /> employee of the City, the City shall select and compensate an attorney who shall provide a <br /> defense for Employee, unless the City Council determines that said Employee was acting outside <br /> of the scope of his duties and responsibilities when engaged in the action or conduct which forms <br /> the basis of the Claim. <br />
