F. The minority participation goals shall be reviewed annually by the City Manager or his designee, Any changes of the goals shall require a majarity vote by Decatur City Councii. SECTI4N 10-4,PR4GRAM ADMINISTRATION: A. The Public Works Duector, ar his designee, shall: {i} Admir�ister and enforce the provisions of this Article, (ii) Monitor, track and report on contractars over the contract duration to ensure compliance with this Article. SECTIQN 10-5.PEIYALTIES: A. If a contractor fails to meet the City's minarity participatian goals and fails ta pravide evide�ce of a good faith effart to meet the gaals,the Public Works Directar or his designee may, as appropriate: (i) Qrder inamediate COTT6C�1V� �Ct1011, as appropriate a�d practicable, to meet the minarity participation goals c�r to show a got�d faith effort toward meeting the goals; {ii) Assess a fine or penalty not ta exceed $2,404 for each o�'fense, and each day an which a violation occurs ar cantinues shall be considered a separate affense; {iii) Withhold the fine ox penalty assessed from the unpaid portion of the contraet; {iv) Qrder that the cantractor will not be cansidered a responsive responsible bidder for future City projects untit the contractc�r provides evidence af mal�cing a good faith effort toward meeting the City's minority participation gt�als.
