FOLICY. <br /> The City of Decatur encourages a diverse workforce for ali public projects. Toward that end, the <br /> City establishes goals for participatiQn by Minority Business Enterprises {MBE) and minority <br /> workers far public warks cantracts. The objectiv�s afthe minority participatic�n goals include: <br /> A. Ensuring non-discrimination in the award and admir�istration af City public wt�rks <br /> eontracts; <br /> B. Encouraging a level playing field an which 1VIBE and minority workers can compete fairly <br /> for City public works contracts; <br /> C. Helging #o remove barriers to the participatit�n of MBE and minority workers in City <br /> pnblic works contracts; <br /> D. Promoting the use afMBE and mint�rity workers in City public works projects; <br /> E. Ensuring the minc�rity participatian goals are narrowly tailored in accardance with <br /> applicable law; <br /> F. Providing appropriate flexibility ta contractors in establishing and providing apportunities <br /> far MBE and minority workers; <br /> SECTIC?N 10-2. DEFINITIQNS: <br /> A. MINORITY: For purpases of t�is Article, the City hereby adopts and incorparates by <br /> reference "minority persc�n" as defined in the Illinois Business Enteiprise for Minarzties, <br /> Females and Persons with Disabilities Act, 34 ILCS 575i2. <br /> B, MINORITY BUSINESS ENTEI2PR.ISE (MBE}: A business that is owned and <br /> contralled by minorities. There xnust be not less than 51 percent minority ownership of the <br /> business,and the minority ownership must control the managemen#and daily aperations of <br /> the business. <br /> SECTIUN 10-3.MINORITY PARTICIPATI()N GOALS IN PUBLIC PROJECTS, <br /> A. Contractars for City projects shall make a good faith effart ta comply with �he following <br /> minimum goals: <br /> {1} Ten {1 Q} percent of the total dollar arnc�unt of the cantract should be perfarmed by <br /> Minority Business Enterprises if subcontracting opportun�ties are available; and, <br /> �2)Eighteen(18)percent c�f the totai hours worked should be performed by zninarity workers. <br /> B. SubcQntracting is not required fc�r a City praject. If a subcantractor is used, the contractor <br /> shall mat�e a good faith effort tc�meet the City's minority participation gr�als. <br /> C. A contractc�r shall provide evidence of ineeting the City's minority participatzon gaals as <br /> directed and required by the Public Works Direetor or provide evidence that it made a <br /> gaod-faith effort to meet the goals. <br /> I?. A gaod faith effort mea2as the contractar took reasonable and necessary steps to achieve the <br /> minority participation goats. Goad faith means the contract€�r activeiy and aggressiveiy <br /> sotzght participation by MBE or minority workers. The City shali consider the quality, <br /> quantity and intensity c�f efforts made by a contractar. <br /> J-3 <br />
