Term. <br /> Initial Tern2, City Manager's appointment is far an indefinite term pursuant to 65 ILCS <br /> 5/5-3-7;unless terminated in accordance with Article V below. <br /> � <br /> ARTICLE V <br /> Termination and Suspension of Emplovment <br /> 5.1. By City For Cause. Council may terminate City Manager's empiayment for ` <br /> cause: <br /> (a} If City Manager l�as violated local, state or federal laws or xegl.ilations prohibiting <br /> the harassment of another person o:n tha basis of sex, race, color, religion,national <br /> origit�, ancestry, age, marital status,physical or mental handicap, genetic <br /> information, sextial orientation or citizenship status,and su�fzcient evzdence has <br /> been provided thereof, and Council determines such violation(s)to be material <br /> intentional; or <br /> (b) If City Manager repeatedly fails to enact directives given by a majority vote of the <br /> City Council; or <br /> (c) If City Manager materially and substantially violates any of the confidentiality <br /> restrictions contained in Article VI below or any of the conflict of interest <br /> restrictions contained in Arti.cle VII below; or <br /> (d} If City Manager is convicted(to include entry of a ple� of guilty or nola <br /> contendere}by a couxt of competent jurisdictian of commission of a criminal act <br /> which adversely affects City's reputation, excluding rninor traffic offenses; or <br /> (e) If the City Manager commits an unethical or fraudulent act ii�the performance of his <br /> work, anci suf�icient evidence thereof has been provided and verified as an unethical or <br /> fraudulent act basec�upon commonly accepted codes of conduct as set forth by the � <br /> International City/County Management Association, and the Council has determined the : <br /> consequences to be adverse to the City; or <br /> (� If upon Council's request City Manager fails to pronnptly submit to the physic�I, E <br /> medical or toxicological examination(s}described in Section 2.7 above; or <br /> 5 <br /> ( <br /> 3uiu�uy C,,2d19 � <br /> Pagc 4 oF9 � <br />
