GENERAL CONDITIONS <br /> GC-9 FAIR EMPLQYMENT PRACTICES <br /> The Contractor and all subcontractors hereunder must comply with the provisions af the <br /> Illinois Human Rights Commission's Rules and Regulations for public contracts and the Equal <br /> Employment Opportunity Clause as contained in the Special Conditions of the Cpntract. <br /> The Contractor and all subcontractors are to make a gaod faith effort to cornply with the <br /> Minority Participatian Goals set forth in Section 28-10 af the City Cade. Documentation is to be <br /> pravided on al( good faith efforts ta comply with the participation goals. This will include, but <br /> not be limited to, entering weekly certified payroll reports, contract and subcontract information, <br /> and payment verification through eFrismSoft, a web-based compliance tracking saftware. <br /> Access ta ePrismSoft is provided by the City of Decatur, <br /> GC-10 INDEMNIFICATION <br /> The Contractor agrees to indemnify and hold harmless the City of Decatur, and its <br /> officers and its employees, fram and against a(1 liability, claims, demands and expenses, <br /> including court costs and attorney fees, on account of any injury, loss or damage which arise out <br /> of ar are in any manner connected with the work to be perforrned under this Agreement, if such <br /> injury, loss or damage is caused in whote or in part by, ar is claimed to be caused in whole or in <br /> part by the negligent acts, errars or omissions of the Contractor, any Subcontractor of the <br /> Contractor, or any officer employee or agent of the Contractor. The obligatians af this Section <br /> shall not apply to damages which the City af Decatur shall become liable by final judgment to <br /> pay to a third party as the result of the negligent aet, error or omission of the City of Decatur, its <br /> officers, ernployees ar agent of the City of Decatur. <br /> GC-11 INSPECTI4N <br /> The Contractor shall give sufficient advance notice of placing orders to permit tests to be <br /> compieted before the materials are incorporated in the work and he sha11 afford such facilities as <br /> the Engineer may require far collecting and forwarding samples and making inspections. All <br /> costs cannected with the furnishing and testing of samples wi11 6e borne by the Cantractar. <br /> Independent testing laboratories may be used provided they meet the appraval of the City. <br /> GG12 LANE CLOSURE PERMITS <br /> It is the Contractor's respansibility to abtain all necessary lane closure permits. Any casts <br /> incurred in obtaining these permits are ta be incidental to the related contract item. Permit fees <br /> will be waived for thase perrnits issued by the City of Decatur. <br /> 37 <br />
