INFORMATItJN Ft)R BIDDERS: <br /> MINORITY PARTICIPATION GOALS <br /> FOR PUBLIC WORKS CONTRACTS <br /> I. Descriptian of the Minorit P�rticipation Goals Pro�ram: <br /> A. The City af Decatur encourages the participation of minarities and Minority Business <br /> Enterprises (MBEs) for City-funded public works construction projects. To camply with <br /> Chapter 28, Section 10,of the City Cade, bidders wi11 make a good faith effort to meet <br /> the following minimum goals: <br /> 1. If subcontracting opportunities are available, l0% af the tatal dollar amount of the <br /> contract should be performed by Minarity Business Enterprises. <br /> 2. Minarity workers should perform 18% of the total haurs worked. <br /> B. Failure to submit a Subcantractor Utilization Statement,the Minority Business <br /> Enterprise Participation Waiver Request or MBE Subcontractor Informatian Form <br /> as described and provided herein, may cause the bid to be rejected and determined nan- <br /> responsive. <br /> IL Pre-Bid Efforts when Awardin� Subcontracts: Bidders sha11 make a good faith effort to <br /> contact and solicit bids from MBEs for available subcontracting. Subcontracting cantact and <br /> bidding is to be made prior ta bid opening. Subcantract information is ta be recorded on the <br /> Subcontractor Utilization Staternent and MBE Subcontractor Informatian Form to be <br /> submitted with the bid documents. <br /> III. Waiver: <br /> A. If a contractor does not or cannot meet the City's rninority participation gaals for <br /> contracts, it may seek in writing a waiver. The waiver request shall include, as <br /> appropriate: <br /> 1. Evidence af the contractor's good faith efforts to secure participation by MBE artd <br /> minarity woricers; <br /> 2. Evidence the contractor received no proposals or inquiries from qualified MBE or <br /> firms that empiay minority workers in response to a good faith effort to secure <br /> participation. <br /> B. Bidders seekin�a waiver of MBE goals must submit with the bid documents a Minoritv <br /> Business Enterprise Participation Waiver Repuest. <br /> IV. Chan�e in the Use of Subcontractors or Self-Performance Status: Before the Prirne <br /> Contractar can deviate from utilizing any of the subcantractars listed an the Subcontractar <br /> Utilization Statement, add subcontractors, or declare the intent to self-perform the work; a <br /> completed Notification of Change in Participation form is to be submitted for each change. <br /> V. Record Keepin�and Repartin� The Prime Contractor and subcontractors agree to <br /> rnaintain recards demonstrative of their goad faith efforts to comply with the participation <br /> goals identified in the City Code. A1t infarmation, inctuding subcontracting, minority <br /> participation, and weekly prevailing wage documentation, will be provided through <br /> ePrismSaft, an electronic web based compliance tracking saftware. Access to ePrismSoft <br /> has been furnished by the City of Decatur.
