The Owner also reserves the right to delay the award af a contract for a period not to exceed 45 days from the date afthe apening. The undersigned further agrees, if awarded the Contract far the work included in this Proposal,to begin and to comp]ete and deliver the work contemplated in accordance rvith all the canditions set forth in the Contract Dacuments. The undersigned has carefully checked the figures inserted by them and understands that they are tl�e Bidder's sole responsibility,and the Owner will not be responsible for any errars or omissians on the part of the undersigned Bidder in preparing this Praposai. The undersigned certifies that this Proposal is genuine, not collusive, or made in the interest or behalf of any person not named as provided in the Instructian to Bidders, and that the undersigned has nat, directty, or indirectiy, induced ar solicited any other Bidder,or induced any ather person, firm, ar corporatian to refrain from submitting a proposal, and the undersigned has nat in any manner saught by col(aszon to secure for themselves an advantage aver any other $idder. Attached, as a proposal guaranty, is a properly certified check made payable to "Treasurer, City of Decatur",Decatur, Illinais, in an amount not less than ten{l0)percent c�f the bid; or a cashier's check rnade payable to "Treasurer, City of Decatur", Decatur, Illinois, in an amount not less than ten{]0}percent of the bid;or a bid bond on a form approved by the City of Decatur, executed by a surety company satisfactpry to the City in an amount not less than ten (1 Q}percent of the bid. It is expressly untlerstaod that the praposal guaranty is given as a guarantee that the bidder will execute the contract and furnish acceptable bands and required insurance, if awarded the work, and the amount thereof represents the agreed damages #hat the Owner will sustain if the bidder fails or refuses within ten (10) days from and including the date of the Notice of Award of the Contract, ta execute and deliver said Contract and deEiver the required bonds and insurance shall6e just cause foar the canceltation of the award and #he forfeiture of the proposal guaranty which shall become the praperty of the City, not as penalty, but in liquidation of damages done. Award may be then made to tY�e nex# lowest qualified bidder, or the work re- advertised and constructed under contract,or otherwise,as the City may decide.
