The Owner reserves the right ta reject any <br /> bid if the evidence submitted by, ar investigation of, such Bidder fails to satisfy the 4wner that <br /> such Bidder is properly qualified to carry out the obligations af the Contract and to complete the <br /> work contemplated therein. Conditional bids will not be accepted. <br /> Each bid must be accompanied with a proposal guaranty either as a praperly certified <br /> check made payable to "Treasurer, City of Decatur," Decatur, Tllinois, in an amount nat less than <br /> ten (1Q) percent of the bid; or a cashier's check made payable to "Treasurer, City of Decatur", <br /> Decatur, Illinois, in an amaunt not less than ten (10) percent afthe bid; or a bid bond an a form <br /> approved by the City, executed by a s�rety campany satisfactory to the City, in an amount nat <br /> less than ten (1Q) percent of the bid. Such praposal guarantees, of the three lowest bidders, nnay <br /> be retained by the City for a period of 45 days after the date of the bid opening. Checks ar bid <br /> bonds frorn other than the three lowest bidders will be returned by the City within seven (7) days <br /> after the date of the bid opening. <br /> Simultaneously with the delivery of the executed Cantract, the Contractor shall furnish a <br /> surety band or bonds as security for faithful perforrnance of this Contract and for the payment of <br /> all persons performing labar on the project under this Contract and furnishing materials in <br /> connection with this Conteact, and other iterns required by the Conditians and Specifications <br /> governing the work. The surety on such bond ar bonds shall be a duly autharized surety <br /> company satisfactary to the Owner. Attorneys-in-fact who sign bid bonds or contract bonds <br /> must file with each bond a certified and effectively dated copy af their Power of Attorney. <br /> The successful Bidder, upon Bidder's failure or refusal ta execute and deliver the <br /> Contract and bonds required within {10) cansecutive calendar days from and including the date <br /> the Bidder has received notice af the acceptance of their bid, shall forfeit to the Owner, as <br /> liquidation of damages dane for such failure or refusal, the security deposited with their bid. <br /> Notice ofthe Owner's intent shall either be hand delivered by the Owner to the $idder's address, <br /> as given on the Cantract Documents, or mailed to such address, first ciass, United States maii, <br /> return receipt requested. Delivery or mailing of said natice to said address shall constitute the <br /> natice herein required without the requirement of an acknowledgment of receipt from the Bidder. <br /> Each Bidder must infarm himself fu11y af the conditions and specificatians relating to the <br /> construction of the project and the emplayment of labor thereon. Failure to do sa will not relieve <br /> a successf�zl Bidder of their obligation ta furnish a11 material and labor necessary ta carry out the <br /> provisions of the Contract. Insofar as possible, the Contractor, in carrying out their work, must <br /> employ such methods or means as will not cause any interruption of or interference with the <br /> work of any other Contractar. <br /> The quantities appearing in the bid proposal are approximate and are prepared for the <br /> comparison of bids. Payment to the Contractor will be made only for the actual quantities af <br /> work perfarmed and accepted or rnaterials furnished accarding to the contract. The propased <br /> quantities of work to be done and materials to be fi�rnished may each be increasecl, decreased, ar <br /> omitted as hereinafter provided. <br /> 7 <br />
