{i} Order imn�ediate corrective actian, as appr4priate and practicabie, to mee# the <br /> rninority participation gaals or to show a good faith effart toward meeting the gaals; <br /> �ii} Assess a fine or penaity nat to exceed $2,0�0 for each off�nse, and each day on <br /> which a violation accurs or continues shall be cansidered a separate offense; <br /> {iii) Vijithhold the ftne or penaity assessed from the unpaid portian of the cantract; <br /> (iv) Order that the contractor will nat be considered a responsive respansible bidder for <br /> future City projects until the contractar provides evidence of making a good faith <br /> effort taward meeting the City"s minority participation goals. <br /> SECTION 10-6. APPEALS: <br /> The pet�alty assessed by the Public Works Director or his designee shall be appealable to the City's <br /> Human Relations Commission. <br /> SECTION 10-7. WAIVER: <br /> A. If a contractar does not ar cannot meet the City°s minority participatian�oals far cantracts, <br /> it may seek in writing a waiver. The waiver request shall include, as apprapriate: <br /> (i} Evidence of the contractar's gaod faith efforts ta secure participation by MBE and <br /> minority workcrs; <br /> (ii} Evidence the contractor received no proposals or inquiries from qualified MBE or <br /> firms that employ minority workers in response to a good faith effort to secure <br /> participation. <br /> B. The Public Works Director or his designee may,at his or her discretian,waive the minority <br /> participation goals upan finding: <br /> (i) The project is essential far city operations; <br /> (ii} Eznergency circumstances require a waiver; <br /> (iii) Evidence of a good faith effart by the cantractor; <br /> (iv} Evidence the contractor received no proposals or inquiries from qualified MBE or <br /> firms that emplQy minority warkers in respanse to a good faith effort ta secure <br /> participation. <br />
