C. A contractor shali provide evic�ence af ineeting the City's minority participatian goais as <br /> directed and required by the Public Works Director ar pravide evidence that it made a <br /> good-faith effort ta meet the goals. <br /> D. A good faith effort means the cantractor toak reasonable and necessary steps to achieve <br /> the minority participation gaals. Goad faith means the contractar activeiy and aggressively <br /> sought participation by MBE or minority workers. The City shall consider the quality, <br /> quantity and intensity af efforts made by a coniractor. <br /> E. Evidence of a gaod-faith effort includes, but is nat limited to,as appropriate: <br /> (i} Soliciting t�raugh alI reasonable and available means the interest af MBE and <br /> minority workers; <br /> (ii} Outreach and recruitment efforts of MBE and minority workers; <br /> (iii) Packaging requirements, when feasible, into tasks or quantities that permit <br /> maximum participatian frorn MBE and minority workers; <br /> (iv) Providing interested MBE and firms that employ minority workers with adequate <br /> informatian abaut the bidding pracess, adequate time to respond and assistance in <br /> respondir►g ta a solicitatian; <br /> (v} Negotiatin�zn good faith with MBE and firms tbat emptoy aminority warkers; <br /> (vi) Assisting interested MBE and firms that employ minority workers in obtaining <br /> bonding, Iines of credit ar insurance; <br /> (vii) Assisting interested MBE and firms that employ minority workers in obtaining <br /> necessary equipment, supplies ar materials; <br /> (viii) Seeking services from available minority camrnunity organizations; minarity <br /> cantractaz•s' groups, minoriry business assistance offices and other organizations, <br /> as apprapriate, to provide assistance in recruiting MBE and minority warkers; <br /> (ix} If an MBE or a firm that emplays minority workers is rejected, providing sound <br /> reasons for rejection based on a thoraugh investigation of the firm; <br /> (x} Providing payroll records or other evidence showing the percentage af minority <br /> workers employed an the project or the percentage of project hours completed by <br /> minority workers; j'This rs provide t�trvu�;h Prevailing Wage dacumentation� <br /> (xi) All other good faith efforts or evidence of due dil'zgence ta rneet the City's minority <br /> participation goals. <br /> F. The minority participation goals shall be reviewed aniaually by the City Manager or his <br /> designee. Any changes af the goals shall require a rnajority vote by Decatur City Council. <br /> SECTION 10-4. PR4GR.AM ADMINISTRATION: <br /> A. The Public Works Director, or his designee, shall: <br /> (i) Administer and enforce the provisions of this Article; <br /> (ii} Monitor, track and report on contractors over the contract duration to ensure <br /> coznpliance with this Article. <br /> SECTION 10-5.PENALTIES: <br /> A.
