4. The CITY has passed a resolutian appropriating sufficient funds #o pay its share of the cost for this improvement, a copy of which is attached hereta as "Exhibit A" and made a par#hereof. The CITY further agrees that upon award of the contract for this improvement, the CITY C3F DECATUR wi11 pay to #he QEPARTMENT OF TRANSPC}RTAT1t}N r�f the STATE OF ILLINQfS from any funds a!lfltted #o the CITY, an amaun# equat to 50% of i#s obligation incurred under this AGREEMENT, and will pay to the said DEPARTMENT the remainder af the abligatian(inctuding any non-participa#ing casts an FA prajects}in a lump surn, upon completion of the project based upon fina! costs. The CtTY further agrees to pass a supplemental resolution to pravide necessary funds for its share af the cost af this improvement 'sfi #he amount appropriated in "Exhibit A„ proves to be insufficient, to cover said cost. 5. The GITY has adopted and will put intr� effect an appropriate orc4inanee, prior #o the STATE's advertising for the proposed work to be performed hereunder, ar shall continue to snforce an existing ordinance, requiring that parking be prohibited within the limits of this impravement, a copy of which is attached here#o as "Exhibi� B", and will in the future prohibit parking at such lacations on or immediately adjacent to this improvement as may be determined necessary by the �TATE from traffic capacity studies. 6. The CITY has adopteci artd wi!! put inta effect an appropriate ordinance, priar #o the STATE's advertising far the proposed work to be performed hereunder, or shall continu� to enforce an exisfing ordinance, prahibiting the discharge of sanitary sewage anci industrial waste water into any sform sewers constructed as a part af this impravement, a copy of which is attached hereto as"Exhibit C'. 7. Prior to the STATE advertising for the work p�oposed hereunder, the dispasitio� of encroachments will be cooperatively resolved with representatives from #he CITY and the STATE.
