Notwithstanding anything to the contrary in this Intergovernmental Lease <br /> Agreement, the provisions of this LIABILITY AND INDEMNIFICATION paragraph <br /> shall survive expiration and/or termination of this Agreement. Notwithstanding <br /> the foregoing, neither party waives any right, defense or immunity available to it, . <br /> including but not limited to those available under the Illinois Local Government <br /> and Governmental Employees Tort Immunity Act (745 ILCS 10/1-101 et seq.) <br /> 9. INSURANCE: <br /> During the term of this Lease/Option, Charleston shall maintain, or cause <br /> to be maintained, in full force and effect and at its respective sole cost and <br /> expense, the following types and limits of insurance: <br /> (i) Workers' compensation insurance meeting applicable statutory <br /> requirements and employer's liability insurance with minimum limits of One <br /> Hundred Thousand Dollars ($100,000) for each accident. <br /> (ii) Comprehensive commercial general liability insurance with minimum <br /> limits of Two Million Dollars ($2,000,000) as the combined single limit for each <br /> occurrence of bodily injury and property damage. <br /> (iii) Automobile liability insurance covering all owned, hired, and non- <br /> owned vehicles in use by Charleston, its employees and agents, with personal <br /> protection insurance and property protection insurance to comply with the <br /> provisions of state law with minimum limits of One Million Dollars ($1,000,000) as <br /> the combined single limit for each occurrence for bodily injury and property <br /> damage. <br /> 6 <br />
