e�: �ssi �: i� <br /> Beginning at the Southeast corner of Lot 1 in Block 6 of said Higgins Addition; <br /> thence South to the Northeast corner of Lot 30 in Block 6 of said Higgins Addition <br /> thence West to the Northwest corner of Lot 29 in Block 6 of said Higgins Addition; <br /> thence North to the Southwest corner of Lot 2 in Block 6 of said Higgins Addition; <br /> thence East to the point of beginning. <br /> WHEREAS, said public right-of-way and alleyway are no longer useful to the public or to <br /> the City or to the owners of the properties abutting thereon as public right-of-way and alleyway; <br /> and, <br /> WHEREAS, no compensation shall be required as the proposed public right-of-way and <br /> alleyway vacations are considered with sale of other City-owned parcels for the proposed <br /> expansion of Community Care Campus that the City is a redevelopment partner of; and, <br /> WHEREAS, all appropriate utility companies were contacted and expressed no objections <br /> to the proposed vacations; and, <br /> WHEREAS,the public interest will be subserved by vacating said public right-of-way and <br /> alleyway and the public will be relieved from the further burden and responsibility of maintaining <br /> the same. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br /> OF DECATUR, ILLINOIS: <br /> Section 1. That upon the conditions set forth herein, the herein described public right-of- <br /> way and alleyway be, and the same is hereby, vacated inasmuch as the same is no longer required <br /> for public use and the public interest will be subserved by such vacations,said public right-of-way <br /> and alleyway being shown on the plats thereaf hereto attached and hereby made a part hereof: <br /> A. A blanket easement for the vacated alleyway between East Condit Street and East <br /> Orchard Street, west of North Warren Street, shall be maintained for utilities as long as <br /> the City's sanitary sewer is there. <br /> B. A blanket easement for East Marietta Street, east of North Water Street and west of North <br /> Warren Street, shall be maintained for utilities as long as the City's utilities are there. <br /> C. The future property owners shall be responsible for maintaining all utility easements <br /> within or relocating all utilities from vacated public rights-of-way per the associated sales <br /> agreement between the City and Crossing Healthcare. <br /> Section 2. The permanent index numbers of the properties acquiring title to the <br /> properties vacated hereby are as follows; street right-of-way vacation: Parcel 1: 04-12-11-351- <br /> 015; alleyway vacation: Parcel 1: 04-12-11-303-016. <br /> Section 3. That there is hereby reserved in, over, along and under the above-described <br /> street and alleyway to the City of Decatur, Illinois, and to the public and to those utilities and <br /> companies as the case may be owning public service facilities, mains, sewers, telephone and <br />
