DEVELOPMENT AGREEMENT <br /> FOR WATER MAIN AND ANCILLARY FACILITIES FOR THE CENTRAL BAPTIST <br /> CHURCH, 1275 WEST MOUNT GILEAD ROAD <br /> This Development Agreement made by and between the City of Decatur, Illinois, a mu- <br /> nicipal corporation("City") and The Central Baptist Church("Owner"). <br /> WHEREAS, the Central Baptist Church is the owner of the property located at 1275 <br /> West Mount Gilead Road, Decatur Illinois 62521, which property is located within the corporate <br /> limits of the City; and, <br /> WHEREAS, Owner has duly annexed said property to the City, in accordance with the <br /> terms and conditions of Ordinance 2004-65; and, <br /> WHEREAS, Owner wishes to develop the premises with a house of worship and ancil- <br /> lary facilities; and <br /> WHEREAS, development of the site is contingent on adequate infrastructure and utility <br /> service to the site; and <br /> WHEREAS, the City agrees that certain infrastructure improvements are necessary, rea- <br /> sonable and acceptable. <br /> NOW, THEREFORE, for and in consideration of the mutual promises and obligations <br /> made and assumed herein, the City and Owner agree as follows: <br /> 1. (a) That prior to construction, Owner shall construct a 12" water main parallel to Rt. <br /> 51 to the north side of Mt. Gilead Road and easterly 200 feet to a point of termination, with a <br /> minimum of 2-12" valves, all required fittings and appurtenances including a 12"X12" Tee and <br /> fire hydrant on the northeast corner of Mt. Gilead and Rt. 51. When completed, the Owner shall <br /> dedicate such main to the City, and the City shall accept said main if it meets all City standards <br />
