<br /> 1. The Decatur Public Transit 5ystem (DPTS) and Bidder acknowledge and agree that,
<br /> notwiths#anding any concurrence by the Federal government in or appraval of the soiic�tat'san
<br /> ar award of the contract, absent the express written consent by the Federal government,the
<br /> Federa!government is noC a party to this contract and shall nat be subject to any abligations
<br /> or liabilities to the DPTS, Bidder, ar any other party {whether a party to that contract}
<br /> pertaining to any matter resulting fram the underlying cantract.
<br /> 2. The Bidder agrees to include the above clause in each subcontract €inanced in whole or in
<br /> part with Federal assistance pravided by Federal Transit Administratian (FTA). it is further
<br /> agreed that the cfause sha{I not be madified,except to identify the subcont�-actor wha will be
<br /> subject to its provisions.
<br /> Pragram Fraud and FaEse ar Fraudulent Statements or Related Acts
<br /> 1. The Bidder acknowledges that the provisions of the Prograrti Fraud Civi# Remedies Act a€
<br /> 5986, as amended, 31 U.S.C. § § 380I �t seq. and U.S. Department of Transportation (DOTj
<br /> �egulations,��Program Fraud Civii Remedies,�� 49 C.F,Et. Part 31,apply to its actions pertainir�g
<br /> to this Project. Upon execution of the underfying contract,the Bidder certifies or afFirms the
<br /> truthfulness and accuracy of any statement it has �ade, it makes, it may rnake, or causes to
<br /> be made, pertaining to the underlying contract or the FTA assisted project for which this
<br /> cantract work is being per�formed, Irt additian to ather penalties that may be applicable,the
<br /> Bidder further acknowledges that if it makes, or causes to be made, a false, fictitious, ar
<br /> €raudulent claim, statement, submissian, or certificatian, the Federal gavernment reserves
<br /> the right to impose the penalties of the Program Fraud Civil Remedies Act of 1986 on the
<br /> Bidder to the extent the Federal g4vernment deems appropriate.
<br /> 2. The Bidder also acknowledges that if it makes, or causes to be made, a false, fictitiaus, or
<br /> fraudulent clairn, statement, submission, or certi�cation ta the Federal goverr�ment under a
<br /> cantract connected with a project that is financed in whole or in part with Federai assistar►ce
<br /> originally awarded by FTA under the authority of 49 U.S.C. §53Q7, the government reserves
<br /> the right to impose the penalties of 18 U.S.C. § 1002 and 49 U.S.C. §5307(n){1}on the Bidder,
<br /> to the extent the Federal gc�vernment deems appropriate.
<br /> 3. The Bidder agrees to include the above two clauses in each subcontract financed in whole or
<br /> in part with Federal assistance provided by FTA. It is further agreed that the clauses shall not
<br /> be modified, except to identify the subcontractar who will be subject ta the provisians.
<br /> Access to Records and Reparts
<br /> Record Retention.The Bidder will retain, and will require its subcantractgrs af al!tiers fio retain,
<br /> complete and readily accessible records related in whole or in part to the contract,
<br /> including, but not limited to, ciata, documents, reports,statistics,sub-agreements,
<br /> leases, arrangements, other third-party agreements of any type, and supporting
<br /> subeontracts materials related to those records.
