General Assembly or the Federal Highway Administratian fail to appropriate or atherwise make available <br /> funds for the PR0IECT. <br /> 16. This Agreement is a reimbursable utility adjustment and is not required to contain the <br /> certification requirements concerning interference with public contracting (720 ILCS 5j33E-1) nor the <br /> Article 54 certifications and disclosures contained in the Illinois Procurement Code (30 ILCS 50Qj. <br /> 17. The COMPANY shall indemnify and save harmless the CITY, its afficers,agents, <br /> emplayees and servants against all lass,damage or expense that it ar they may sus#ain as a result of any <br /> suits, actions or claims af any character brought an account of property damage, injury to ar death of <br /> any persan or persons, including all persons perfarming any work on the utility adjustment,which may <br /> arise in connection with the work to be performed by the COMPANY or any contractor it may hire <br /> pursuant to this Agreement. The COMPANY shail not be obiigated ta indemnify and save harmless the <br /> CITY from liability for injury or death proximately caused by negligence of an employee, agent or servan# <br /> of the CITY. <br /> 28. This Agreement shall be binding upon and to the benefit of the parties hereta,their <br /> successors and assigns.
