Excerpts from Plan Commission Meeting of.Iuly 11, 2019: Case No. 19-27 Petition of FANNIE COLE for a Conditional Use Permit in the R-3 Single- Family Residence District to allow for a Day �;are Home,Large in an existing residence located at 642 SOUTH OAKLAND AVENUE, proposed to be consolidated with 1090 WEST TUTTLE STREET. The properties are zoned R-3 Single-Family Residence District It was moved and seconded (Frantz/Johnson) tc� forward Case No. 19-27 to the City Council with a recommendation of approval as set forth in the staff report. Mr. Scott Dedert was sworn in by Mrs. Janet Poland. Mr. Dedert discussed and presented slides of the site and surrounding properties (available for viewing upon request) along with staff's recommendation for agproval of the petition based on the staff report distributed to the Plan Commission prior to the meeting (staff report is on file and is available for reviewing by request) with the following condit�ons: 1. A maximum of sixteen (16) children per shift are al?owed. 2. The hours of operation are Monday thro►.�gh Friday 6:00 a.m. to 12:00 a.m. 3. A maximum of three (3) employees are �llowed. 4. A minimum of three (3) off-street parkin�g spaces are required, in addition to the two (2) in the proposed garage. 5. A new six (6) feet in height is required w-ithin the rear yard after the garage and breezeways are constructed, as approved by the Economic and Community Development Department. 6. A final plat is required to be submitted amd recorded to combine the two lots within the subject site. 7. Approval of a site plan is required before building permits are to be submitted. 8. Architectural plans need to be approved b�fore co�istruction takes place. 9. Five (5) shrubs of no more three(3) feet ii�height are required as approved by the Economic and Community Development Department. Mr. Darrell Reynolds, representative for the petitioner, was sworn in by Mrs. Poland. Mr. Reynolds stated that the residences will be combined by building a garage in the middle and having a breezeway from each house. Mr. Reynolds said Ms. Cole purchased the house since her residence is behind this property and she runs a daycare center. She has cared for young children for over thirty(30) years and wants to keep them safe. Mr. Rick Johnson asked if the homes would aesthetically look the same. Mr. Reynolds said he is putting new siding on that will match. Mr. Bruce Frantz asked if the children would b� travelin� back and forth between the structures. Mr. Reynolds stated the daycare will be moved int�� the home he is remodeling. One home will be her residence and the other the daycare center. Ms. Edna Palmer was sworn in by Mrs. Poland. Ms. Edna Palmer said she has known Ms. Cole for quite a, few years and she is a wonderful care giver and she admires her for the service she gives to families. She would like to see her request approved. There were no obj ectors present. Upon call of the roll,Commission members Tom Brinkoet�er,Bill Clevenger,Jason Drake,Bruce Frantz, Terry Howley, Rick Johnson and Acting Chairman Susie Peck voted aye. Acting Chairman Peck declared the motion carried.
