Economic&Coinmuiuty Development
DATE: 8/19/2019
MEMO: No. 19-50
TO: Honorable Mayor Julie Moore Wolfe and City Council
FROM: Scot Wrighton,City Manager
Raymond Lai,AICP,Economic and Community Development Director
SUBJECT: Ordinance granting a Conditional Use Pernut(CUP)to allow for a Day Care Home,I.arge in an existing residence,
proposed to be consolidated with another single-family residence zoned R-3 Single-Family Residence District. 642 South
Oakland Avenue and 1090 West Tuttle Street
SUMMARY RECOMMENDATION:
Staff recommends approval of the Conditional Use Permit with the following conditions for the subject site:
1. A maximum of sixteen(16)children per shift are allowed.
2. The hours of operation are Monday through Friday 6:00 a.m to 12:00 a.m ..
3. A maximum of three(3)employees are allowed.
4. A minimum of three(3)off-street parking spaces are required,in addition to the two(2)in the proposed garage.
5. A new fence six (6) feet in height is required within the rear yard after the garage and breezeways are constructed, as
approved by the Economic and Community Development Department.
6. A final plat is required to be submitted and recorded to combine the two lots within the subject site. The property cannot be
further subdivided after the construction is completed.
7. Approval of a site plan is required before building permits are to be submitted.
8. Architectural plans need to be approved before construction takes place.
9. Five(5)sluubs of no more three(3)feet in height are required as approved by the Economic and Community Development
Deparhnent.
The City Plan Commission voted 7-0 to recommend approval of this petition at the July 11, 2019 meeting; the relevant draft
minutes of the meeting are attached.
BACKGROUND:
The subject site consists of two parcels,0.28 acres and 0.068 acres in size respectively. Both parcels are owned by the petitioner
and each is occupied by a residential dwelling, one much larger than the other. The larger single-family residence at 642 South
Oakland Avenue has been issued an approval under a State of Illinois license for a Day Care Large-Home, but without a city
permit. The petitioner intends to construct a garage and connect the larger single-family residence with two breeze-ways to the
existing smaller single-family residence at 1090 West Tuttle Street to make all into one building. Upon fizrther review following
the Plan Commission meeting, staff believes that a stipulation should be incorporated, prohibiting the property to be further
subdivided in the furizre after the proposed construction is completed. The smaller single-family residence building will become
an accessory building for the daycare home operation,
The petitioner has been operating a small and large daycare out of her home at 642 South Oakland Avenue for almost 25 years.
In 2010, the State of Illinois issued a license to the petitioner to operate a large daycare within her home, for a maximum of
sieen(16)children. The petitioner currently has a total of siateen(16)minor children ranging from 16 weeks to 12 years old for
care of less than 24 hours at the residence. There is a six(6) foot high privacy fence in the rear yard at 642 Oakland Avenue
residence for outdoor activities. The petitioner has met other requirements for joining adjacent lots.
For further details, please refer to the attached Plan Commission staff report.
POTENTIAL OBJECTIONS: None
