STAFF REPORT <br /> Decatur City Plan Commission <br /> Hearing Date July 11, 2019 <br /> Case No. 19-27 <br /> Property Location 642 South Oakland Avenue and 1090 West Tuttle Street <br /> Request Conditional Use Permit (CUP) to allow for a Day Care Home, Large <br /> in an existing residence, proposed to be consolidated with another <br /> single-family residence zoned R-3 Single-Family Residence District. <br /> Petitioner Fannie Cole <br /> Representative Darrell Reynolds,New Beginnings Contractors Inc. <br /> BACKGROUND <br /> The subject site consists of two parcels, 0.28 acres and 0.068 acres in size respectively. Both <br /> parcels are owned by the petitioner and each is occupied by a residential dwelling,one much larger <br /> than the other. The larger single-family residence at 642 South Oakland Avenue under a State of <br /> Illinois license but without a city permit. <br /> A"Large Day Care Home"can be defined in the Zoning Ordinance as"A business licensed by the <br /> State of Illinois conducted wholly within a private residence,wherein the owners residing thereon, <br /> along with any additional caregivers allowed by the State license,provide care for minor children <br /> for less than 24 hours per day, and where the number of children cared for exceeds the maximums <br /> for Day Care Home, Small. The maximum number of children cared for shall not exceed the <br /> maximum allowed by the State of Illinois." A "Small Day Care Home" is defined in the Zoning <br /> Ordinance as "a private residence wherein the owners residing thereon provide care for less than <br /> 24 hours per day for no more than three additional minor children other than the owner's dependent <br /> children." <br /> The petitioner intends to construct a garage and connect the larger single-family residence with <br /> two breeze-ways to the existing smaller single-family residence at 1090 West Tuttle Street to make <br /> one building. The smaller single-family residence building will become an accessory building for <br /> the daycare home operation. The petitioner has been operating a small and large daycare out her <br /> home for almost 25 years. In 2010,the State of Illinois issued a license to the petitioner to operate <br /> a large daycare within her home,which the maximum number of children allowed are sixteen(16). <br /> The petitioner currently has a total of sixteen (16) minor children ranging from 16 weeks to 12 <br /> years old all of which, stay less than 24 hours at the residence. Currently, there is a six (6) feet in <br /> height privacy fence present in the rear yard at 642 Oakland Avenue residence for outdoor <br /> activities. <br />
