Page 2 of 3 <br /> Case No. 19-38 <br /> September 5, 2019 <br /> convenience at the location."The proposed use of a carwash is generally compatible with the area. <br /> The surrounding uses are commercial in nature with a shopping center to the north,a mostly vacant <br /> commercial center to the south, a fast-food restaurant to the west and a bank/real estate off`ice to <br /> the east. The subject site fronts on a major arterial roadway (Pershing Road), allowing visibility <br /> and access. <br /> The second standard is "designed, located, and proposed to be operated that the public health, <br /> safety and welfare will be protected."The facility is located and designed to be operated in a way <br /> the public health, safety and welfare will be protected. The on-site traffic circulation is efficient. <br /> There are ample stacking spaces for the proposed car wash. No traffic backing out to Pershing <br /> Road would be anticipated. <br /> The third standard is the proposed use "will not cause substantial injury to the value of other <br /> property in the neighborhood in which it is to be located." The proposed carwash with vacuum <br /> bays should not cause injury to the value of other properties in the areas. The site was used for a <br /> carwash previously for over several years and it seems to have not had an adverse effect on the <br /> area. <br /> STAFF RECOMMENDATION <br /> Staff recommends approval of the Conditional Use.Permit with the following conditions: <br /> 1. No outside speakers shall be permitted except for the carwash drive-through facility. <br /> 2. The building located at 303 E. Pershing Road must be demolished before a Final Minor <br /> Plat is approved. <br /> 3. A Final Minor Plat must be approved and recorded before a Site Plan will be approved. <br /> 4. The trash enclosure must be screened as approved by the Department of Economic and <br /> Community Development. <br /> 5. Final site, landscaping and lighting plans shall be submitted to and approved by the <br /> Economic and Community Development Department, Public Works Department and the <br /> Fire Department prior to permits being released. <br /> PLAN COMMISSION ACTION <br /> Section XXII.A.2. requires the Plan Commission to holci a public hearing on a Conditional Use <br /> Permit request, and then forward its report and recommendation to the City Council for final <br /> approval. A motion to forward Case 19-38 to City Council by the Plan Commission with a <br /> recommendation is warranted. <br /> This report constitutes the testimony and recommendation of the Planning and Sustainability <br /> Division, Economic and Community Development Department, City of Decatur. <br /> Joselyn Stewart <br /> Transportation Planner <br />
