REAL ESTATE PURCHASE AGREEMENT <br /> THIS AGREEMENT ("Agreement")is entered into by and between the City of Decatur, <br /> Illinois, an Illinois municipal corporation("City") and Michael D. Deatherage, (`Buyer"). <br /> RECITALS <br /> A. The City is a municipal corporation as set forth in the Illinois Municipal Code, 65 ILCS <br /> 5/1-1-1, et• seq. <br /> B. The City is a home rule unit under Article VII Section 6(a)of the Illinois Constitution <br /> (IL Const. 1970,Art. VII, Sec. 6(a)). <br /> C. The City owns property, a portion of which is leased to the Decatur Public Library for <br /> use as a public library and a portion of which is used for parking. <br /> D. The City Council has determined that revisions and repairs are necessary for the parking <br /> areas and has entered into a contract for the plan implementing those revisions and repairs which <br /> plan also reduces the amount of paved parking area and returns a portion to greenspace. <br /> E. The Buyer owns property adjacent to a portion of the properly owned by the City, more <br /> specifically, an area located at the southeast corner used previously as a paved parking area. <br /> F. The area adjacent to Buyer's property has been determined to not be necessary for public <br /> parking for Library patrons and was not included in the contract for parking revision and repair <br /> and is not proposed to be revised or repaired by the City but rather returned to green space. <br /> G. The Buyer is in need of additional parking space to expand and improve their currently <br /> operating business. <br /> H. The City desires to transfer to Buyer the property immediately adjacent to Buyer for use <br /> as additional parking for Buyer. <br /> NOW,THEREFORE, in consideration of the foregoing recitals,the mutual covenants <br /> and agreements hereinafter set forth, and for good and valuable consideration,the receipt, <br /> sufficiency and adequacy of which are hereby acknowledged,the parties agree as follows: <br /> 1. The foregoing recitals are incorporated herein as fully stated as a part of this <br /> Agreement. <br /> 2. Subject to the terms and conditions of this Agreement,the City sha11 transfer the <br /> .�-,� <br />
