A. That each MS4 member agency retains the right of final decision on lands the <br /> MS4 member agency owns or exercises control over in regards to the use and <br /> management of soil, water, and other natural resources, as well as any issues, <br /> opinions, findings, or actions resulting from this Agreement, including <br /> enforcement of all ordinances and regulations regarding soil erosion and sediment <br /> control. <br /> B. To comply with the nondiscrimination provisions as contained in Titles VI and <br /> VII of the Civil Rights Act of 1964, as amended, the Civil Rights Restoration Act <br /> of 1987 (Public Law 100-259) and other nondiscrimination statues,namely <br /> Sections 504 of the Rehabilitations Act of 1973, Title IX of the Education <br /> Amendments of 1972 the Age Discrimination Act of 1975, and in accordance <br /> with regulations of the Secretary of Agriculture (7 CFR- 15, Subpart B)which <br /> provide that no person in the United States shall, on the grounds of race, color, <br /> national origin, age, sex,religion, marital status or disability be excluded from <br /> participation in,be denied the benefits of, or be otherwise subjected to <br /> discrimination under any program or activity,receiving Federal financial <br /> assistance from the Department of Agriculture or any agency thereof. <br /> C. That except as provided herein or mutually agreed upon,no charges or fees for <br /> labor, equipment, wages, or materials will be billed by or to any other party <br /> specifically included in this Agreement. <br /> D. This Intergovernmental Agreement shall become effective on the date of the last <br /> signature affixed hereto. The Agreement may be modified at any time by mutual <br /> written consent of the parties hereto. Any party may terminate the Agreement,by <br /> sending thirty(30)days written notice by first class mail to the other parties. In <br /> the event of a termination by any MS4 member agency,the Agreement shall <br /> continue in full force and effect with the remaining parties. Following the <br /> issuance and receipt of a request for amendment or a notice of termination, a <br /> meeting of the officially designated representative of all parties will be called. <br /> E. That no party to this Agreement shall assign this Agreement,nor any interest <br /> arising herein, to any other party without the prior written consent of all parties <br /> involved. <br /> F. That nothing herein contained is intended or should be construed as in any <br /> manner creating or establishing a relationship of copartners between the parties, <br /> or as constituting the District(including its officers, employees and agents)the <br /> agent, representative, or employee of each MS4 member agency for any purpose <br /> or any manner,whatsoever. Likewise,nothing contained herein is intended or <br /> should be construed as constituting any of the MS4 member agency(including its <br /> officers, employees, and agents) as an agent representative,or employee of the <br /> 2 <br />
