Macon County Municipal Separate Storm Sewer System (MS4) Intergovernmental Agreement This Intergovernmental Agreement is made and entered into by and between the CITY OF DECATUR, a municipal corporation of the State of Illinois, (hereinafter referred to as "Decatur"),the VILLAGE OF FORSYTH, a municipal corporation of the State of Illinois, (hereinafter referred to as "Forsyth"), the COUNTY OF MACON, a body politic and corporate of the State of Illinois, (hereinafter referred to as"Macon'), the VILLAGE OF MT. ZION, a municipal corporation of the State of Illinois, (hereinafter referred to as "MT. ZION"), with the above collectively referred to as "MS4"(Municipal Separate Storm Sewer System), and the MACON COUNTY SOIL AND WATER CONSERVATION DISTRICT, a body politic and corporate of the State of Illinois (hereinafter referred to as "District"). WHEREAS, landowners and occupiers,natural resource agencies and other governmental agencies all benefit from well planned and implemented measures intended to protect soil, water and other natural resources; and, WHEREAS, the above-mentioned parties share a common objective of assisting the general public as well as other local, state, and federal units of government in the understanding, development and wise use of natural resources in the respective MS4 member agency' jurisdictions in Macon County, Illinois; and WHEREAS, soil,water and other natural resources must be protected from degradation and depletion that often results from land-disturbing development activities when runoff and erosion are not properly controlled; and, WHEREAS, such adverse effects on these natural resources can be detrimental to the health, safety and general welfare of the public. NOW, THEREFORE, the parties to the Intergovernmental Agreement mutually agree to exercise, in a coordinated manner,their respective authorities to carry out educational programs to serve the public interest in natural resource conservation, establish a framework to increase cooperation and coordination between the parties and to avoid duplications of effort within the municipalities. I. AUTHORITY The parties hereby represent that each has the right and authority to enter into this Intergovernmental Agreement pursuant to provisions of the Illinois Constitution, Illinois Statues and their respective ordinances and resolutions.
