performed. City may accept a separate owner's protective liability <br /> policy in lieu of additional insured status on Contractor's liability <br /> policies. <br /> 3. Commercial Automobile Liability: <br /> Bodily Injury& <br /> Property Damage Limit <br /> Each Occurrence $1,000,000 <br /> The policy shall cover owned, non-owned and hired vehicles. The <br /> coverage shall provide by endorsement that the City, its officers, and <br /> employees shall be named as additional insureds with respect to the <br /> policies and any excess liability coverage for occurrences arising in <br /> whole or in part out of the work and operations performed. <br /> 4. Umbrella (Excess) Liability: <br /> Any policy shall provide excess limits over and above the other <br /> insurance limits stated herein. Contractor may purchase insurance for <br /> the full limits required, or a combination of primary policies for lesser <br /> limits and remaining limits provided by the umbrella policy. <br /> Contractor shall file with City, certified copies of the original <br /> policies or certificates of insurance setting forth the coverage, limits, <br /> and endorsements. A certificate of insurance shall include a <br /> statement "the coverage and limits conform to the minimums <br /> required by the City of Decatur for "CITY OF DECATUR SINGLE <br /> STREAM RECYCLING PROGRAM" indicating the City's <br /> additional insured status. In no event shall any failure of City to <br /> receive certificates or to demand receipt be construed as a waiver of <br /> the Contractor's obligation to obtain and keep in force the required <br /> insurance. <br /> All costs for said insurance shall be considered incidental to this Contract. Coverage <br /> in the minimum amounts set forth herein shall not be construed to relieve Contractor <br /> from its obligation to indemnify the City more than the coverage according to the <br /> Contract. <br /> O.
