R2021-93 Resolution Authorizing a Contract Between the City of Decatur and Midwest Fiber, Inc. of Decatur for Processing Single Stream Recyclables

For and in consideration of the following benefits and covenants set forth in this Contract; the City of Decatur, an Illinois Home Rule Municipality ("City") and Midwest Fiber, Inc. ("Contractor") hereby agree as follows: Section 1. Definitions City shall mean the current incorporated boundary of City of Decatur as well as any annexed property during the term of the contract. Contractor shall mean Midwest Fiber, Inc. of Decatur. Contract Manager shall mean City official in charge of City's Single Stream Recycling program as identified in other parts of this contract. This information will be updated, should any changes occur. Data Sharing shall mean the collection, analysis and dissemination of information regarding the processing and marketing of recyclable material as defined in other parts of this agreement. Facility shall mean all contiguous land, structures and improvements on the land used for the storage and processing of material collected through the Single-Stream Recycling Program. Glass shall mean glass (clear, brown and green)jars,bottles and containers. No window glass, dinner ware or ceramics. Hauler shall mean any person, firm or corporation licensed by the City to collect the recyclable materials at the curb within the corporate limits of the City. Metals shall mean Aluminum cans trays and foils, Steel Cans and Tin/Bi-Metal Cans. Plastics shall mean plastic bottles, containers and packages made from various resins including PETE, HDPE, PVC, LDPE,PP,PS and other plastics, codes#1 though#7. Plastics will exclude construction and automobile products. Paper shall mean Office, Computer, note books,paperback books and gift wrap paper, Magazines, Catalogs, Telephone books, Chip Board(like cereal boxes, gift boxes etc.), newspaper, carrier stock(like soda can carrying case), Junk Mail. Recycle shall mean process the used and discarded objects/materials into objects/materials that may be reused for ultimate consumption and manufacturing and/or remarketed for value. Recyclable Materials shall mean material that has been recovered or diverted from the nonhazardous solid waste stream for purpose of reuse,recycling or reclamation and a substantial portion of which is consistently used in the manufacture of products, which may otherwise be produced using raw or virgin materials.
