47� <br /> WHEREAS, Chapter 46 of the City Code of the City of Decatur, Illinois provides certain <br /> emergency authority; and, <br /> WHEREAS,the City of Decatur, Illinois is a Home Rule Unit under the 1970 State of Illinois <br /> Constitution. <br /> 1 <br /> 1 <br /> NOW,THEREFORE, in accordance with Section 2 of Chapter 46 of the City Code of the City <br /> of Decatur,Illinois and the relevant provisions of the Illinois Compiled Statutes, it is hereby <br /> proclaimed and declared: <br /> SECTION 1. That there is a public health emergency caused by the failure of the HVAC <br /> systems of the Decatur Public Library Premises causing unsafe conditions for users and <br /> employees. <br /> SECTION 2. That in issuing this Proclamation and Declaration of Emergency, I am relying <br /> 1 <br /> upon each and every matter recited in the preamble, which is hereby incorporated by <br /> reference. <br /> a <br /> SECTION 3. That the following actions are authorized as set forth specifically: <br /> A. The City Manager, in consultation and concurrence of the Mayor may determine <br /> what repairs and replacement is necessary for the HVAC system of the Decatur Public <br /> Library, a public building and facility in order for the building to remain open to the <br /> public and authorize the expenditure of funds as necessary for such repairs or <br /> replacement. <br /> B.To perform other governmental functions as needed to accomplish said repairs or <br /> replacement. <br /> SECTION 4.That all actions as described above which have been taken prior to the date of <br /> this Proclamation and Declaration are authorized as if this Proclamation and Declaration <br /> were in effect at the time the actions were taken. <br /> 1 <br /> SECTION S.That-this shall be filed with the City Clerk and copies of this Declaration provided <br /> to the news media and post a copy at the Civic Center. <br /> 3 <br /> 11111111 pill 11 <br />
