PROCLAMATION AND DECLARATION OF EMERGENCY PURSUANT TO CHAPTER 46 OF THE CITY CODE WHEREAS, the City of Decatur, Illinois, an Illinois municipal corporation is a home rule 1 authority community under the Constitution of the State of Illinois ("City");and, 1 WHEREAS,the City of Decatur, Illinois is the owner of the building and facility commonly referred to as the Decatur Public Library("Premises");and, WHEREAS,the City of Decatur, Illinois has entered into a lease agreement ("Agreement") with the Library Board of Trustees for the use of the Premises;and, WHEREAS, the Agreement provides that the City will maintain in good working order certain portions of the HVAC system which include the components for the air conditioning unit of the Premises;and, WHEREAS,the Premises are used by residents and citizens of Decatur for research, book searches as well as a place of refuge during certain hours of the day and during certain weather.conditions;and, WHEREAS,in May,2021,the HVAC system of the Decatur Public Library failed causing the temperature to reach excessive heat levels;and, WHEREAS, bids for replacement of the HVAC components necessary for the repair of the air conditioning system have been obtained and are in an amount that require City Council approval for the authorization and expenditure of the funds;and, WHEREAS,the next regularly scheduled meeting of the City Council is scheduled for June 7, 2021;and, WHEREAS,the heat index is not expected to reach a level naturally.that would allow the ! comfortable and safe use of the Premises by the public and employees prior to June 7,2021 without the repair,replacement and use of the HVAC system;and, WHEREAS,it is necessary and appropriate for the City of Decatur,Illinois to take measures to protect the public's health in the use of the Premises; and, c ITT-11 11811114111 If Illilli fill oil #Jftilfllll If 111111 11144t I lifill If of Ill" EXHIBIT A
