Section 3. CMI will be responsible for reviewing and determining all applicable federal, <br /> state and local laws, statutes and other regulations relating to the use of ARP funds provided <br /> under this Agreement. <br /> Section 4. The ARP funds provided by the City shall be used by the CMI only for <br /> operating expenses, necessary maintenance of the CMI facility and necessary repairs to the CMI <br /> facility, and used in a manner consistent with and in compliance with the use of the ARP funds <br /> as set forth in all applicable federal, state and local laws, statutes, and other regulations. <br /> Section 5. That should the funds be used for or in any manner contrary to those uses set <br /> forth in this Agreement, upon written demand by the City, the CMI will repay to the City the <br /> funds used contrary to the terms set forth herein. <br /> Section 6. Repayment of funds by the CMI to the City shall be due and owing no later <br /> than thirty(30) days following demand of such repayment by the City. <br /> Section 7. CMI hereby acknowledges and agrees that if it fails to comply with any or all <br /> provisions of this Agreement, the City may, in its sole discretions, terminate this Agreement and <br /> demand repayment of all funds provided to CMI pursuant to the terms of this Agreement. <br /> Section 8. Upon written request, CMI agrees to provide to City or its duly authorized <br /> representatives, access to any books, documents, papers and records of CMI which pertain to the <br /> ARP funds provided to CMI for the purpose of monitoring, making audits, examinations, and <br /> photocopying. <br /> Section 9. CMI shall be required to maintain all required records for the period of time <br /> designated by the City as required by the terms of the ARP Act and any other laws, statutes and <br /> other related regulations including, but not limited to, financial records setting forth all <br /> disbursements and payroll records, equipment records setting forth the details of all purchases <br /> and other supply records. <br /> Section 10. CMI agrees to provide quarterly reports to the City setting forth the use and <br /> disbursement of the ARP funds provided pursuant to the terms of this Agreement. <br /> Section 11. CMI agrees to provide any and all reports which may be required by the City <br /> for compliance with the ARP statute and any other federal or state law, statute or other <br /> regulation. <br /> Section 12. CMI agrees that no person shall, on the grounds of race, color, religion, <br /> national origin, sex, sexual orientation, gender identity, marital status, age, source of income, or <br /> physical or mental disabilities, be excluded from participation in, be denied the benefits of or be <br /> otherwise subjected to discrimination under any program or activity for which CMI receives and <br /> uses the ARP funds from or through the City. <br /> Section 13. CMI agrees to comply with Title VI of the Civil Rights Act of 1964; Title <br /> VII of the Civil Rights Act of 1968; Section 104(b) and Section 109 of the Housing and <br />
