AGREEMENT BETWEEN CITY OF DECATUR <br /> AND CHILDREN'S MUSEUM OF ILLINOIS REGARDING <br /> AMERICAN RESCUE PLAN FUNDS <br /> This Agreement ("Agreement") is made and entered into between the City of Decatur, <br /> Illinois, an Illinois municipal corporation ("City") and the Children's Museum of Illinois <br /> ("CMI"), for and in consideration of the mutual covenants and promises and good and valuable <br /> consideration contained herein. <br /> WHEREAS, the City has received funds from the American Rescue Plan funds ("ARP"); <br /> and, <br /> WHEREAS, the ARP funds received by the City may be used for specific eligible <br /> activities including providing aid to tourism industries to respond to the negative economic <br /> impacts of the COVID-19 pandemic; and, <br /> WHEREAS, the CMI is part of the tourism industry that was negatively impacted by the <br /> COVID-19 pandemic; and, <br /> WHEREAS, the CMI is a major tourism destination in the City and an important part of <br /> the tourism industry in the City; and, <br /> WHEREAS, the CMI was closed for an extended period of time due to the COVID-19 <br /> pandemic; and, <br /> WHEREAS, the CMI suffered significant losses and was delayed in any upgrades and <br /> improvements as a result of the COVID-19 pandemic; and, <br /> WHEREAS, the extended closure, loss of funding and other negative economic impacts <br /> on the CMI threatens the long term viability of the CMI. <br /> NOW, THEREFORE, in consideration of the mutual promises and covenants, it is agreed <br /> between the parties hereto the following: <br /> Section 1. The City agrees to provide to CMI the sum of Two Hundred Thousand <br /> Dollars ($200,000.00) from its portion of the ARP funds pursuant to and under the terms of this <br /> Agreement. <br /> Section 2. The CMI shall prepare a sustainability plan ("Plan") setting forth a strategic <br /> plan for its continued successful operation which Plan shall be approved by the Board of <br /> Directors of the CMI and the City of Decatur's City Manager or his designee. The City shall not <br /> be under any obligation to provide any funds to the CMI prior to submission and approval of the <br /> Plan as set forth in this section. <br />
