or secured party the existence of the Landowner-Tenant relationship of this lease and the terms hereof regarding title to the <br /> Landowner's share of the crop. <br /> G)LANDOWNER AGREES TO PAY THE FOLLOWING EXPENSES: <br /> 1. Taxes on premises and improvements owned or held by Landowner. <br /> 2. Materials the Landowner deems necessary for repairs and improvements on the above described premises. <br /> H)TENANT AGREES TO PAY THE FOLLOWING EXPENSES: <br /> 1. All machinery,equipment,power and labor required to farm the premises properly. <br /> 2. Labor,except skilled labor,required for repairs and improvements. <br /> I)TENANT SHALL HAVE THE FOLLOWING DUTIES IN OPERATING THE PREMISES: <br /> 1. To cultivate the premises faithfully and in a timely,thorough and businesslike manner. <br /> 2. To keep premises neat,and to prevent any unnecessary waste,damage,or soil erosion. <br /> 3. Not to allow noxious weeds to go to seed on said premises,but to destroy same; to cut all weeds, sprouts and brush in fence <br /> rows, drainage ditches,waterways;and on roads adjoining as often as needed each year without charge to the Landowner for <br /> labor. <br /> 4. To kap open ditches,tile drains,tile outlets,grass waterways,and terraces in good repair. To preserve established watercourses <br /> or ditches,and to refrain from any operation that will injure them <br /> 5. Not to burn corn stalks,cobs,straw or other residue grown on the premises,nor to remove any hay,cobs or straw or other residue <br /> except by agreement,and only as permitted by law. <br /> 6. To clip small grain stubble and to prevent noxious weeds from going to seed. <br /> 7. Not to permit trampling of rotation fields by livestock in wet weather when the soil is soft,and to prevent rooting by bogs. <br /> 8. To follow such crop rotation,tillage practices,fertilizer programs,conservation measures,and arrangements as are worked out <br /> with the Landowner or his Agent. To apply fertilizer and limestone at the rate stated in the annual crop plan. Landowner is not <br /> liable for the cost of over application of fertilizer,limestone,herbicide and/or insecticide. <br /> 9. To comply with pollution control and environmental protection requirements,and to implement soil erosion control practices. <br /> 10. To use prudence and care in transporting, storing, handling, and applying all fertilizers, pesticides, herbicides, and other <br /> chemicals and similar substances.To read and follow instructions on the labels for the use of such materials in order to avoid <br /> injury or damages to persons or property or both on the leased premises and adjoining areas. To comply with all applicable <br /> federal,state and local statutes,regulations,rules and ordinances. <br /> 11. Not to cut, bulldoze, damage or destroy(or permit any such damage or destruction) of trees without written permission of <br /> Landowner. <br /> 12. Not to permit,encourage,or invite other person or persons to use any part or all of this premises for any purpose or activity not <br /> directly related to its use for agricultural production,including hunting. <br /> 13. Not to dispose of solid waste nor permit others to dispose of solid waste on the premises. <br /> 14. Not to store chemicals on the premises other than the current season. When chemicals or petroleum products are stored on the <br /> premises,they will be only those planned to be used on the premises and they will be in closed,tight containers above ground <br /> and clearly marked. No chemicals or chemical containers will be disposed of on the premises. <br /> 15. To certify all acres planted and production harvested from the premises each year in compliance with the Govermucnt Program <br /> in effect at that time as required by the Farm Service Agency Office. <br /> 16. Roadside ditches will be mowed at least once after August 15 and once in September. <br /> J) SPECIAL AGREEMENT: The Tenant will not commit the Landowner to pay for repairs or improvements on the above <br /> described premises. <br /> IQ ADDITIONAL AGREEMENTS: <br /> 1. Tenant shall not erect or permit to be erected upon said premises,any structure,building,fence or sign of any kind whatsoever, <br /> except by the written consent of the Landowner, nor purchase any materials or incur any expenses for the account of the <br /> Landowner without Landowner's express approval and will not make a claim for labor at any time unless Landowner has given <br /> written permission at a previous date. <br /> 2. Tenant shall not add electrical wiring,plumbing or heating without written permission of the Landowner,and when same is given <br /> it shall pass inspection of local building authorities,power company,and insurance companies. Said additions shall immediately <br /> become part of the Landowner's premises against which the Tenant will have no further claim unless otherwise agreed in writing. <br /> 3. Tenant shall not cut live trees for sale purposes or personal use. <br /> 4. Limestone and application costs are depreciated over five crop years. Tenant will be reimbursed for any undepreciated portion. <br /> Landowner will reimburse upon final division. <br /> 2 <br />
