Appendix D <br /> City of Decatur <br /> Community Development Block Grant-Public Services <br /> Program Criteria <br /> I. GENERAL COMPLIANCE WITH APPLICABLE LAWS: CONTRACTOR agrees to comply with <br /> the requirements of Title 24 of the Code of Federal Regulations, Part 570(HUD regulations <br /> concerning CDBG) and 2 CFR Part 200 of Uniform Administrative Requirements, Cost <br /> Principles and Audit Requirements. <br /> CONTRACTOR and any sub-CONTRACTORS also agree to comply with all other applicable <br /> Federal, State of Illinois, and local laws, regulations, and policies governing the funds <br /> provided under this agreement. <br /> CONTRACTOR additionally agrees to comply with any changes issued to the CITY'S <br /> program due to the use of mixed CITY and HUD funds. In addition, the CONTRACTOR <br /> understands that changes issued to the CITY'S CDBG HUD funding may materially alter <br /> the terms of this Agreement. The CITY will distribute any amendments to the programs <br /> within thirty(30) days and CONTRACTOR must acknowledge the receipt. <br /> CONTRACTOR acknowledges and affirms that the CONTRACTOR and any sub- <br /> CONTRACTOR has the organizational capacity to adhere to collection and reporting <br /> requirements, satisfying performance measures, as required by Uniform Administrative <br /> Requirements, Cost Principles, and Audit Requirements for Federal Awards; Final Rule <br /> ("Omni Circular") Subpart D, Sections 200.300-200.303. The CONTRACTOR's capacity <br /> shall be demonstrated by various methods, including but not limited to: <br /> A. Use of OMB-approved standard information collections when providing financial <br /> and performance information; <br /> B. Financial data is provided for performance accomplishments of the Contract <br /> award; <br /> C. Cost information shall be distributed to demonstrate cost effective practices; <br /> D. The CONTRACTOR shall provide the CITY with the same information required by <br /> the Federal awarding agency under sections 200.301 and 200.210; and <br /> E. All expenditures shall be accounted for, in compliance with requirements under <br /> section 200.302, as is interpreted by the CITY'S Director of the Economic and <br /> Community Development. <br /> The CONTRACTOR agrees to follow either the procurement guidelines set forth in <br /> Section 200.320 of the Omni Circular, or the procurement guidelines/standards, <br /> which the CONTRACTOR uses during its normal course of business; whichever of the <br /> two guidelines is more restrictive.
