5. Borrower agrees to pay all expenses of payee, or assigns, in enforcing the terms of the Note <br /> including but not limited to attorney fees, court costs, service fees and other expenses of court <br /> or non-court collection proceedings. <br /> 6. Borrower agrees to follow all requirements of the Mortgage, HOME Funding Forgivable Loan <br /> Agreement, and HOME Program Deed Restrictions. Borrower agrees to verify annually rental <br /> occupancy and maintain the property to all applicable local, state, and federal laws, ordinances, <br /> codes, regulations, and standards. Borrower expressly acknowledges that these funds are <br /> subject to U.S. Department of Housing and Urban Development rules and regulations, and as a <br /> result strict compliance with all terms of the HOME Agreement, Mortgage, and Deed <br /> Restrictions, as well as all local, state, and federal laws, ordinances, codes, regulations, rules, <br /> and standards are required. Copies of all of the aforementioned documents are on file with the <br /> City Clerk's office. <br /> 7. Borrower agrees that any balance due hereunder, if not payable sooner, shall be due and <br /> payable upon the occurrence of the earlier of any of the following events, after the expiration <br /> of any applicable notice and cure period set forth in the HOME Agreement: <br /> (1)failure to maintain property in the manner required under the HOME Agreement or <br /> (2) upon the date Borrower,jointly or severally, conveys or transfers any right,title or <br /> interest in the premises, legal or equitable, in whole or in part, in any manner or form, <br /> or, if any Agreement or Contract be entered into for such purpose without immediate <br /> transfer of said legal or equitable title, whether with or without consideration paid to <br /> Borrower, or any of them, without the consent of the City; or <br /> (3) the date of the partial, if insurance proceeds are insufficient to restore, or total <br /> hazard or casualty loss of any nature to'the premises. <br /> 10. This Note is secured by a Mortgage, which shall constitute a lien on the premises, 1370 East <br /> Carrie Lane, Decatur, Illinois. Any breach of the terms to be performed by Borrower under the <br /> terms of this Note and the balance due hereunder shall be immediately payable to the City.
