Anderson Plaza <br /> Decatur, Illinois 62523 This space for use of Recorder <br /> MORTGAGE AND SECURITY AGREEMENT <br /> This MORTGAGE AND SECURITY AGREEMENT (hereinafter"Mortgage") is made this 15th <br /> day of June,2022. By the Mortgagor, Carrie Lane Supportive Housing, LLC, an Illinois <br /> limited liability company,with a principal address of 141 South Main Street, Suite 601, <br /> Decatur, Illinois 62523 (hereinafter, "Borrower"),in favor of the Mortgagee, City of Decatur, <br /> Illinois, an Illinois municipal corporation with a principal address of 1 Gary K.Anderson <br /> Plaza Decatur Illinois 62523her ,in er "Lender" <br /> ( e aft .) <br /> WHEREAS, Borrower and Lender have entered into a HOME Funding Forgivable Loan <br /> Agreement (hereinafter,the"HOME Agreement"),a copy of which is on file in the City <br /> Clerk's Office of the City of Decatur,and the definitions and terms of which are <br /> incorporated herein by this reference as if fully set forth herein, and which provides, <br /> among other things,that the Lender will loan to the Borrower certain HOME Program <br /> funds for the development of a 20-unit affordable housing project, of which 10 units shall <br /> be directly funded through the aforesaid loan, for the use of low- and very low-income <br /> households as described in the HOME Agreement. <br /> WHEREAS,to ensure, among other things,that the development of the Property, as <br /> hereinafter described, is completed,and that the Borrower continues the use of the <br /> Property as set forth in the HOME Agreement and other Loan Documents executed in <br /> connection therewith, Borrower has executed a Promissory Note in favor of the Lender and <br /> is indebted to the Lender in the principal sum of Two Hundred and Fifty Thousand <br /> Dollars ($250,000.00),which indebtedness is evidenced by the Borrowers Promissory <br /> Note dated of even date herewith (hereinafter"Note"),a copy of which is hereto attached <br /> as Exhibit A and incorporated by this reference. <br /> To secure to the Lender the repayment of the indebtedness evidence by the Note,and all <br /> renewals, extensions, and modifications thereof; the performance of the covenants and <br /> agreements of the Borrower contained in the Note between the Borrower and Lender; the <br /> payment of all sums advanced in accordance herewith to protect the security of this <br /> Mortgage; the performance of the covenants and agreements contained within the HOME <br /> Agreement between the Borrower and Lender; and the performance of the covenants and <br /> agreements of the Borrower contained herein,the Borrower does hereby mortgage,grant, <br /> 1 <br />
