Fire Station#3 Staff Parameters <br /> The City solicited proposals for the sale of Fire Station 3 in December, encouraging a planned <br /> use that would add value to the neighborhood and community. There were eight proposals <br /> submitted ranging in uses and offer price. An evaluation committee reviewed and ranked these <br /> based on the combination of these factors. <br /> The City would like to retain some control over the future of the historic public safety building. <br /> The proposed use that can preserve the buildings current condition through compatible use is the <br /> cornhole business. This business plan presented was the most compatible with adjoining <br /> residential neighborhood and requires the fewest building modifications,while still generating <br /> sales,utility,and real estate taxes and new jobs. This proposal was for$100,100.00 <br /> In order to facilitate this property transaction staff proposes the following for City Council <br /> approval at a future date. <br /> • The City will sell the property using a contract for deed. <br /> • A contract for deed transfers the legal responsibility to the buyer for such things as <br /> utilities,taxes,insurance, etc.,keeping the City from having to continue these types of <br /> expenses. <br /> • We propose$10,100 down on contract, and 48 equal installments of$1875 per month. <br /> • Buyer could pay off contract and assume title no sooner than 24 months, should they pay <br /> it off early. <br /> • City would retain a right of first refusal on the property for fair market value for 35 <br /> additional years. <br /> • Should the business default on the contract the City retains ownership. <br /> The property is currently zoned residential. The property has commercial zoning on 2 sides of it <br /> and residential adjoining. Almost any proposed commercial use would require some type of <br /> zoning relief. In order to allow for the commercial activities proposed in the cornhole business <br /> plan, staff proposes rezoning this building under a Planned Development PD zone. This <br /> essentially allows for a specific use as requested only. The City would not be rezoning this to a <br /> B-1 (lowest commercial zone)for example which allows for a dozen categories of uses,rather <br /> zoning entitlements would be presented and approved as a planned package. A PD zoning also <br /> allows the City to put any reasonable restrictions necessary to minimize impacts of commercial <br /> activities not compatible with adjoining properties and the entrance to Fairview Park. <br /> The City also by virtue always retains the authority to review and permit any modifications to the <br /> building necessary. This proposed use will continue to bring life to this building,while not <br /> changing it completely from decades gone by. With direction from Council staff will prepare a <br /> sale contract as directed and begin some type of zoning action,again as directed by City Council. <br /> Both of these two actions will require City Council approval and could come before Council for <br /> consideration in March or April. <br />
