B. Case No. 22-04 Petition of ViaSAT to grant a Conditional Use permit to allow for the <br /> construction of a ground based satellite dish in the R-1 Single Family Residence District <br /> located at the NORTHWEST CORNER OF BRUSH COLLEGE ROAD AND HUBBARD <br /> AVENUE <br /> It was moved and seconded (McDaniel/Schwarz) to forward Case No. 22-04 to the City Council <br /> with a recommendation of approval as set forth in the staff report. <br /> Mrs. Stewart discussed staff's recommendation for approval of the petition based on the staff <br /> report distributed to the Plan Commission prior to the meeting (staff report is on file and is <br /> available for reviewing by request). <br /> Randy Jones,Petitioner, was sworn in by Deanna Buck. The petitioner explained the need for the <br /> conditional use permit for the subject site which is located at the Northwest corner of Brush <br /> College and Hubbard Avenue. <br /> Mr. Kent Newton had questions about the 1St standard not being addressed,Mr. Crowe explained <br /> how the petition meets the 1St standard since telecommunications is a public necessity and the <br /> property is in an industrial area. <br /> Upon call of the roll, Commission members Bruce Frantz, Pat McDaniel, Matt Naber, Kent <br /> Newton, James Schwartz, Andrew Taylor, and Susie Peck voted aye. Motion carried. <br /> C. Case No. 22-06 Petition of GAILEY EYE CLINIC to rezone the property at 3035 <br /> NORTH MACARTHUR ROAD from R-1 Single Family Residence District to 0-1 Office <br /> District <br /> It was moved and seconded (McDaniel/Schwarz) to forward Case No. 22-06 to the City Council <br /> with a recommendation of approval as set forth in the staff report. <br /> Mrs. Stewart discussed staff's recommendation for approval of the petition based on the staff <br /> report distributed to the Plan Commission prior to the meeting (staff report is on file and is <br /> available for reviewing by request). <br /> Stephanie Brown,Representative for Chastain& Associates,was sworn in by Deanna Buck. <br /> There was discussion on this item. <br /> Upon call of the roll, Commission members Bruce Frantz, Pat McDaniel, Matt Naber, Kent <br /> Newton, James Schwartz, Andrew Taylor, and Susie Peck voted aye.
