Each Occurrence Limit $1,000,000 <br /> Commercial Automobile Liability <br /> Bodily Injury&Property Damage, $1,000,000 <br /> Combined Single Limit <br /> The policy shall cover owned, non-owned, and hired vehicles. Upon request,the contractor shall file <br /> with the City certified copies of all insurance policies and all accompanying endorsements. The <br /> contractor shall supply certificates of insurance setting forth the coverage, limits, and endorsements <br /> before the City will execute the contract.The certificate of insurance shall include the City of Decatur, <br /> its officers,and employees an additional insured. In no event shall any failure of the City of Decatur to <br /> receive certificates or to demand receipt be construed as a waiver of the contractor's obligation to <br /> obtain and keep in for the required insurance. <br /> It shall be an affirmative obligation upon the contractor to advise the City within two days of the <br /> cancellation or substantive change of any insurance policy set out above,and failure to do so shall be <br /> construed to be a breach of the contract. The contractor will hold the City harmless from all claims, <br /> suits, actions, damages or causes of action in any way arising during the term of the agreement, <br /> including reasonable attorney's fees for any personal injury, loss of life or damage to person or <br /> property sustained because of or because of the products or services supplied.Contractor's insurance <br /> will be primary. <br /> Upon full payment of all monies owed to the Contractor,all drawings,specifications,reports,and any <br /> other project documents(Work Product)prepared by the Contractor in connection with any or all the <br /> services to be furnished thereunder shall be delivered to the City for the express use of the City.The <br /> Contractor shall have the right to retain original documents but shall cause to be delivered to the City <br /> such quality of documents to assure total reproducibility of the documents delivered.All information, <br /> worksheets,reports,design calculations, plans and specifications shall be the sole property of the City <br /> upon full payment of all monies owed to the contractor unless otherwise specified in the negotiated <br /> agreement. The contractor agrees that basic survey notes and sketches, charts, computations, and <br /> other data prepared or obtained by the Contractor pursuant to this Agreement shall be made <br /> available,upon reasonable request,to the City without cost and without restriction or limitation as to <br /> their use. All field notes, test records, and reports shall be available to the City upon reasonable <br /> request. <br /> 11. CERTIFICATIONS <br /> Executing this Agreement constitutes acknowledgement,acceptance,and certification of the accuracy <br /> of the following certifications,and any other certifications required under any applicable law relating <br /> 4 <br />
