Exhibit A LAKE DECATUR WATERSHED PROTECTION PROGRAM AGREEMENT In consideration of the foregoing recitals, the mutual covenants and agreements hereinafter set forth, and for good and valuable consideration,the receipt, sufficiency and adequacy of which are hereby acknowledged, this Agreement ("Agreement") is entered into by and between Ronald R. Helm &Jeanne E. Helm ("Owner") and the City of Decatur, Illinois, an Illinois municipal corporation("City"). The parties agree as follows: 1. Owner agrees to participate in City's Lake Decatur Watershed Protection ("Program") for soil erosion control, nutrient management and water quality improvements for property they own located in Macon County, Illinois more particularly described as That part of the North 100 acres of the West '/_�, of the West '/_z, of Section 14, Township 17 North, Range 3 East of the Third Principal Meridian, Macon County, Illinois, described as follows: beginning at the Southwest corner of the Northwest '/, of said Section 14; thence N. 0 degrees 29 minutes 40 seconds E. 3 72.00feet along the West line of the Northwest %, of said Section 14 to a point on the Easterly right of way line of F.A.1 Route 72; thence N. 40 degrees 15 minutes 31 seconds E 283.43 feet along said right of way line; thence N. 34 degrees 39 minutes 24 seconds E 508.01 feet along said right of way line; thence N. 34 degrees 46 minutes 46 seconds E 586.10 feet along said right of way line; thence N. 33 degrees 19 minutes 58 seconds E. 1011.36 feet along said right of way line to a point on the East line of the West ''/_�, of the Northwest Y4, of said Section 14; thence S 0 degrees 34 minutes 04 seconds W. 2328.39 feet along said East line; thence S. 0 degrees 34 minutes 04 seconds W. 635.00 feet; thence N. 89 degrees 52 minutes 29 seconds W. 1342.63 feet to a point on the West line of the Southwest %4, of said Section 14; thence N. 0 degrees 28 minutes 46 seconds E. 629.00 feet along said West line to the point of beginning, as per Plat of Survey dated November 28,2005 by Robert L. Cox Illinois Professional Land Surveyor, No. 2442. Situated in Macon County, Illinois. and hereinafter referred to as "Property." 2. Subject to the terms and conditions of this Agreement, Owner shall plan, install and complete all construction and projects on the Property as set forth in Exhibit 1, attached hereto and incorporated by reference, including but not limited to all land adjustments, conservation projects, cropping, and management projects hereinafter referred to collectively as"Project."
