i <br /> SECOND AMENDMENT TO SUBRECIPIENT AGREEMENT WITH <br /> SHEMILAH OUTREACH CENTER REGARDING <br /> CLEAN-UP GREEN-UP INITIATIVE <br /> This Second Amendment to the Subrecipient Agreement dated August 11, 2021 between <br /> the City of Decatur, Illinois, an Illinois municipal corporation("City") and the Shemilah <br /> Outreach Center, an Illinois Not for Profit Corporation("Subrecipient") is made and entered into <br /> this '1 I" day of r�ovemlo e.r , 2022 by the above parties, wherein the parties stipulate <br /> as follows: <br /> WHEREAS, the City and Subreceipient entered into an Agreement dated August 11, <br /> 2021 ("Agreement") for the purpose of Subrecipient administering the City's Clean-up Green- <br /> Up Initiative in the Johns Hill neighborhood; and, <br /> WHEREAS, the City and Subreceipient entered into a First Amendment to the <br /> Agreement on April 4, 2022 ("First Amendment")which extended the time for Shemilah to <br /> perform to December 31, 2022; and, <br /> WHEREAS, the City and Subreceipient are desirous of amending the Agreement again to <br /> extend the time for Subreceipient to perform; and, <br /> WHEREAS, the City and Subreceipient are desirous of amending the Agreement to <br /> increase the maximum amount the City will pay to Subreceipient for the work performed <br /> pursuant to the Agreement; and, <br /> NOW THEREFORE, in consideration of the mutual promises and covenants contained <br /> herein,the sufficiency of which is hereby acknowledged, the parties agree as follows: <br /> Section 1. The parties hereby find that all of the recitals contained in the preambles to <br /> this Second Amendment are full,true and correct and do incorporate them into this Second <br /> Amendment by this reference. <br /> Section 2. That Section 3 (A) of the Agreement is amended to increase the amount of <br /> funds appropriated under the terms of the Agreement to not exceed Two Hundred Seventy-Five <br /> Thousand Dollars ($275,000). <br /> Section 3. That Section 4 of the Agreement is amended to extend the term of the <br /> Agreement to no later than December 31, 2023. <br /> Section 4. That any and all other terms and conditions of the Agreement and First <br /> Amendment not in conflict with the provisions of the Second Amendment shall remain in full <br /> force and effect. <br /> Section 5. That any and all terms and conditions of the Agreement and First Amendment <br /> in conflict with the provisions of the Second Amendment are hereby modified and revoked. <br />
