WHEREAS,the City has determined that DOVE has the capacity to manage and <br /> administer supportive services for homeless individuals. <br /> NOW, THEREFORE, in consideration of the mutual promises and covenants, it is <br /> agreed between the parties hereto the following: <br /> Section 1. The City agrees to sell the Property in the amount of$190,000 to DOVE for <br /> the purposes of transitional and permanent housing for homeless individuals. <br /> Section 2. The City agrees to appropriate an amount not to exceed Five Hundred and <br /> Sixty Thousand Dollars ($560,000) from its portion of the Funds to Dove for the renovation of <br /> Property for the purposes of providing transitional and permanent housing for homeless <br /> individuals. <br /> Section 3. DOVE shall be responsible for administering the funds in a manner <br /> satisfactory to the City and substantially consistent with any standards and regulations that are <br /> specified in this Agreement and adherence to the same is a condition of City providing these <br /> Funds. <br /> Section 4. DOVE agrees to expend the total amount of Funds covered in this Agreement, <br /> solely for the agreed upon activities and in accordance with the conditions outlined in this <br /> Agreement. <br /> Section 5. DOVE will be responsible for reviewing, following, and determining all <br /> applicable Federal, State, and local laws, statutes and other regulations relating to the use of <br /> Funds provided under this Agreement. <br /> Section 6. The Funds provided by the City shall only be used by DOVE for residents <br /> within the corporate city limits of Decatur, IL and for the purposes of and pursuant to and under <br /> the terms of this Agreement. <br /> Section 7. DOVE hereby acknowledges and agrees that if it fails to comply with any of <br /> the provisions of this Agreement or if the Funds are used for or in any manner contrary to those <br /> uses set forth in this Agreement, City may, in its sole discretion, terminate this Agreement and, <br /> upon written demand by the City, DOVE will repay to the City the funds used contrary to the <br /> terms set forth herein. <br /> Section 8. DOVE agrees to provide to the City or its duly authorized representatives, <br /> access to any books, documents,papers, and records of DOVE which pertain to the Funds <br /> provided for the purpose of monitoring,making audits, examinations, and photocopying. <br /> Section 9.DOVE and City shall execute a deed restriction,note,and mortgage as approved <br /> by City(hereto incorporated as Exhibits A-C),which instruments shall require DOVE to maintain <br /> the subject property up to minimum code standards, including lead hazard control requirements, <br /> Page 60 of 239 <br />
