inspection must be corrected immediately and more frequent inspections may be scheduled for
<br /> the property at the City's discretion.
<br /> Section 10. Both DOVE and City shall maintain records for the twenty(20) year period
<br /> of affordability, and an additional 5 years. DOVE's obligation hereunder shall survive
<br /> termination of this Agreement. As required under 24 CFR 92.508(a)(3)(i), 92.508(a)(3)(ii),
<br /> 92.508(a)(3)(iii), 92.508(a)(3)(iv), and 92.508(a)(3)(xiv).
<br /> Section 11. No person who exercises or has exercised any functions or responsibilities
<br /> with respect to the project assisted with HOME funds or who are in a position to participate in a
<br /> decision-making process or gain inside information with regard to the activities may obtain a
<br /> financial interest or financial benefit from the HOME-assisted activity, or have a financial
<br /> interest in any contract, subcontract, or agreement with respect to the HOME-assisted activity or
<br /> the proceeds from such activity, either for themselves or those with whom they business or
<br /> immediate family ties, during their tenure or for one year thereafter. Immediate family ties
<br /> include (whether by blood, marriage, or adoption)the spouse, parent(including a stepparent),
<br /> childg a stepchild),child), brother, sister(including a stepbrother or stepsister), grandparent,
<br /> ( P
<br /> grandchild, and in-laws of a covered person. A covered person applies to any person who is an
<br /> employee, agent, consultant, officer, or elected official or appointed official of the city or DOVE.
<br /> Section 12. DOVE shall not use any funds provided under this Agreement for religious
<br /> activities, to promote religious interests, or for the benefit of a religious organization in
<br /> accordance with the federal regulations specified in 24 CFR 92.504 (c)(3)(x).
<br /> Section 13. DOVE shall comply with all the provisions of HUD regulations identified in
<br /> 24 CFR Part 92, as now written, or subsequently amended.
<br /> Section 14. DOVE agrees to provide the City with regular progress reports due on the
<br /> 15th of each month and all other reports which may be required by the City for compliance with
<br /> HUD, Freedom of Information Act and any other federal or state law, statute, or other regulation.
<br /> Section 15. DOVE agrees to comply with Title VI of the Civil Rights Act of 1964; Title
<br /> VII of the Civil Rights Act of 1968; Section 104(b) and Section 109 of the Housing and
<br /> Community Development Act of 1974, as amended; Section 504 of the Rehabilitation Act of
<br /> 1973; the American with Disabilities Act of 1990 as amended, and the Age Discrimination Act
<br /> of 1975 as amended.
<br /> Section 16. DOVE hereby assumes liability for and agrees to protect, hold harmless, and
<br /> indemnify the City, its assigns, officers, employees, directors, agents and servants from and
<br /> against all liabilities, obligations, losses, damages, penalties,judgments, settlements, claims,
<br /> actions, suits,proceedings, costs, expenses, and disbursements, including legal fees and expenses
<br /> of whatever kind and nature, imposed on, incurred by or asserted against the City, its assigns,
<br /> officers, employees, directors, agents, and servants in any way relating to or arising out of any
<br /> allegations, claims, or charges regarding the use of the Funds by DOVE, including but not
<br /> limited to the violation by DOVE of any of its covenants or agreements under this Agreement,
<br /> and any injury to any person, loss of life, or loss or destruction of property in any way arising out
<br /> of or relating to the performance or operation of DOVE's operations and use of Funds.
