Newell, Pearsall, and Mahr: <br /> Enclosed is a copy of Stipulated Agreement 2271 concerning voluntary vacation and <br /> permanent closure of the William Street (AAR/DOT #154643W9 railroad milepost BD® <br /> 276.13) highway-rail grade crossing of Decatur& Eastern Illinois Railroad's track in Decatur, <br /> Macon County, Illinois. <br /> The City must supply a local decision vacating the roadway on both sides of the William <br /> Street grade crossing. The final vacation and physical closure of the roadway shall not take <br /> place until a Commission Order has been issued authorizing an incentive payment from the <br /> Grade Crossing Protection Fund. The City must submit a certified copy of the local vacation <br /> draft decision document at the same time as the Execution Page of the Agreement is <br /> submitted to this office. The City must also submit a certified copy of the final vacation <br /> decision document to all parties as evidence when the crossing vacation is finalized. <br /> Please read the entire Agreement before execution. The City and the Railroad must also <br /> submit Project Manager Information (see Exhibits C and C1, respectively, of the Agreement) <br /> at the same time as the Execution Pages. In addition, the City is required to submit a certified <br /> copy of the Resolution (See Exhibit D of the Agreement) indicating the City is financially <br /> willing and able to bear the cost of maintaining barricades as outlined in Section 5 of the <br /> Agreement. <br /> In accordance with the provisions of the Commission's Recommended Procedures for <br /> Initiation and Execution of the Stipulated Agreement, all parties must sign the Execution <br /> Page of the agreement within 60 days from the date of mailing and return it to our office or <br /> the terms of the agreement shall be renegotiated or declared void. <br /> 527 E.Capitol Avenue,Springfield,IL 62701 <br /> Telephone[217]782.7660 Fax[217]524-4637 <br />
