5/10/23,3:06 PM Item Coversheet <br /> Public Works <br /> DATE: 5/5/2023 <br /> MEMO: 2023-45 <br /> TO: Honorable Mayor Julie Moore Wolfe and City Council Members <br /> FROM: Scot Wrighton,City Manager <br /> Matt Newell, P.E.,Public Works Director <br /> SUBJECT: <br /> Resolution Rescinding a Local Public Agency Agreement for Federal Participation of Brush College Road/Faries Parkway <br /> Railroad Grade <br /> SUMMARY RECOMMENDATION: <br /> It is recommended that the City Council approve the attached Resolutions: <br /> 1. Resolution rescinding a Local Public Agency Agreement for Federal Participation for the construction of the Brush College <br /> Road/Faries Parkway railroad grade separation. The Agreement authorized the expenditure of$48,640,691. Section 09- <br /> 00933-01-BR. <br /> 9-00933-01-BR. This agreement was approved by the City Council on January 18,2022. When the City rejected the higher than <br /> expected bids received in January,2022,IDOT did not execute this agreement and it is no longer in effect for this project. <br /> 2. Resolution authorizing a Joint Funding Agreement for Construction Work for the construction of the Brush College Road/ <br /> Faries Parkway railroad grade separation. The Agreement authorizes the expenditure of$62,589,265 for the construction of the <br /> grade separation which represents the following funds: <br /> a. $35,800,000 in National Highway Freight Program funds(Federal Funding). <br /> b. $11,424,255 in Grade Crossing Protection funds. <br /> C. $6,000,000 in Multi-Model Transportation Bond Funds(Rebuild Illinois Funds). <br /> d. $1,500,000 in State fund commitment for Martin Luther King,Jr. Drive/Wood Street reallocated to Brush College <br /> Road. <br /> e. $7,865,010 in City funds. City funds are budgeted to include State MFT,Water,and Storm Water funds. The final <br /> allocation of City funds will be determined once bids are received and actual costs are known. Under an agreement with the <br /> Norfolk Southern Railway Company,the City will be reimbursed$1 million for this project. The City was awarded a <br /> Congressional Earmark from Senator Tammy Duckworth through the Federal Railroad Administration for$2 million. The <br /> City has requested an additional$5 million in Grade Crossing Protection Funds for the project. The City is still seeking <br /> additional funding through applications for additional grants to offset the City's cost obligation. <br /> 3. Resolution rescinding a Local Public Agency Engineering Services Agreement between the City of Decatur and AECOM <br /> Technical Services,Inc.,to perform construction engineering services for the Brush College Road/Faries Parkway railroad <br /> grade separation project for a fee of$4,541,821. Section 09-00933-01-BR. This was approved by the City Council on <br /> December 6,2021. With the passage of time since that agreement and increased personnel costs and an expected increase in <br /> the construction length as the project begins late in the year, it was considered best to do a fresh agreement. <br /> 4. Resolution authorizing a Local Public Agency Engineering Services Agreement between the City of Decatur and AECOM <br /> Technical Services,Inc.,to perform construction engineering services for the Brush College Road/Faries Parkway railroad <br /> grade separation project for a fee of$5,012,278.00. It is expected that the City will be reimbursed for$3.5 million of this <br /> expense as part of the Joint Agreement currently being reviewed by the Illinois Department of Transportation(IDOT). <br /> BACKGROUND: <br /> Joint Funding Agreement <br /> The Brush College Road Grade Separation Project is to be advertised for bid in the State bulletin on Friday,May 12,2023,with a <br /> planned bid letting by the State of Illinois on June 16,2023.
