F. The County shall each month provide a report to the City indicating Animal Control <br /> and shelter activity for month and year to date. This report shall include, but is not limited to, the <br /> following: total of all animals impounded, including dogs, cats, bite cases, owner-released animals, <br /> stray animals, adoptions, reclamations, animals euthanized, and a total of all citations and Notices to <br /> Appear issued from the Acts and the Macon County Animal Control Ordinances. <br /> G. The County shall when necessary prosecute violations of the Acts throughout the <br /> County of Macon,except as otherwise specifically provided in this section. Further,the County shall <br /> prosecute violations of Macon County Ordinances in all unincorporated areas of the County of <br /> Macon. However,nothing herein shall prohibit the City from prosecuting violations of the City Code <br /> occurring within the City of Decatur. Investigation of felony animal related cases originating and <br /> occurring in the City will be handled by the City. All other violations and criminal cases from <br /> anywhere in Macon County will be prosecuted by the County. If the City desires a necropsy be <br /> performed of an animal involved in a case the City is investigating,then the City will be responsible <br /> for the cost and transportation of the animal to the facility performing the necropsy. Non felony <br /> violations that occur in the City that are being handled by the County may be handled by issuance of <br /> the City ordinance violation, referral to the Macon County State's Attorney or by referral to City <br /> Legal Counsel for prosecution in Administrative Court. <br /> H. The County shall be entitled to retain all fees, fines,penalties, and late fees collected <br /> for enforcement and prosecution of violation of the Acts and Macon County Animal Control <br /> Ordinance, except felony enforcements and felony cases investigated by the City. Payments by the <br /> public to the County shall be made at a location or locations as determined by the County. <br /> 3. The City agrees to perform the following functions, obligations and duties: <br /> A. The City may prosecute violations of the City Code occurring within the corporate <br /> limits of the City of Decatur,if it chooses to do so.The City will be required to handle and investigate <br /> only felony violations of State and City animal related cases within the corporate City limits, and, <br /> unless the City voluntarily takes over the prosecution as an ordinance violation the County will <br /> prosecute all misdemeanors and felonies, and other categories of animal violation throughout Macon <br /> County. <br /> B. The City shall be entitled to retain all fines, penalties, and late fees collected for <br /> enforcement and prosecution of violation of the City Code. Payments by the public to the City shall <br /> be made at a location or locations as determined by the City. <br /> C. The City shall maintain a central data base for all dogs and cats registered within Macon <br /> County under the Animal Control Act. Said data base shall include rabies inoculation information <br /> for all dogs and cats anywhere within the County of Macon, as well as registration information for <br /> all dogs and cats anywhere in the County of Macon. The City shall be responsible for the costs <br /> incurred in the maintenance of said data base. The City shall share the information contained in <br /> said data base with the County as the County's request. <br /> -4- <br />
