The Consulting Engineer expressly acknowledges,recognizes and agrees that the only authority to <br /> approve Amendments to this Agreement or the Scope or Services or the cost(s)therein is with the <br /> City Council of the City. <br /> SECTION II. BASIC SERVICES <br /> The Consulting Engineer shall, after written authorization to proceed with the Construction Support <br /> Phase: <br /> A. General Duties. The Consulting Engineer shall consult with and advise the City's Representative as <br /> provided herein and in the General Conditions of the construction contract for the Project. The <br /> primary responsibility of the Consulting Engineer in this phase of the work shall be quality control <br /> inspection of the materials,construction methods and techniques to assure that the Contractor builds <br /> the project in accordance with the plans and specifications. <br /> B. Construction Support and Reporting. The Consulting Engineer shall make visits to the site at <br /> intervals appropriate to the various stages of construction to observe as an experienced and qualified <br /> design professional the progress and quality of the executed work of the Contractor and to determine <br /> in general if such work is proceeding in accordance with the Contract Documents. During such visits <br /> and on the basis of on-site observations,the Consulting Engineer shall keep the City's Representative <br /> informed of the progress of the work, shall endeavor to guard the City against defects and deficiencies <br /> in such work and may disapprove or reject work failing to conform to the Contract Documents. <br /> C. Review of Technical and Procedural Aspects. The Consulting Engineer shall review and approve(or <br /> take other appropriate action in respect to Shop Drawings,the results of tests and inspections and <br /> other data which each Contractor is required to submit,determine the acceptability of substitute <br /> materials and equipment proposed by the Contractor(s), and receive and review(for general content <br /> as required by the Specifications)maintenance and operating instructions, schedules,guarantees, <br /> bonds and certificates of inspection which are to be assembled by the Contractor(s). <br /> D. Conferences and Meetings. The Consulting Engineer shall attend meetings with the City's <br /> Representative and the Contractor,such as pre-construction conferences,job conferences,and other <br /> project-related meetings. <br /> E. Reports. The Consulting Engineer shall, <br /> 1. Furnish the City's Representative periodic reports,as required,on progress of the Work and of <br /> the Contractor's compliance with the Shop Drawings and sample submittals. <br /> 2. Consult with the City's Representative,in advance of scheduled major tests,inspections,or start <br /> of important phases of the Work. <br /> 3. Review proposed Change Orders and make recommendations to the City's Representative. <br /> 4. Report immediately to the City's Representative upon the occurrence of any accident. <br /> F. Prepare Engineer's Pay Estimate.The Consulting Engineer shall,based on the Consulting Engineer's <br /> on-site observations as an experienced and qualified design professional and on review of the <br /> Inspectors Daily Reports and Quantity Book,determine the amounts owing to the Contractor(s)and <br /> prepare an Engineer's Payment Estimate recommending the amount of payment for completed work. <br /> Such recommendations of payment shall constitute a representation to the City's Representative, <br /> based on such observations and review,that the work has progressed to the point indicated and that to <br /> the best of the Consulting Engineer's knowledge,information and belief,the quality of such work is <br /> in accordance with the Contract Documents(subject to an evaluation of such work as a functioning <br /> 2 <br /> Template Last Revised:2/03/2022 <br />
