ORDINANCE NO. ORDINANCE AMENDING CITY CODE CHAPTER 38 -STORMWATER ORDINANCE- WHEREAS, on April 21, 2014, the City Council approved Ordinance 2014-14 which amended Chapter 38 of the City Code to add a stormwater fee which was identified as the means to generate funding for stormwater infrastructure and drainage improvements and, WHEREAS, the City is using stormwater fees to maintain its stormwater infrastructure and provide stormwater improvements, however, the current fee structure is insufficient to meet the ongoing stormwater improvement needs of the City and, WHEREAS, the City has identified additional stormwater drainage improvement projects that could begin to be addressed with additional stormwater fees; therefore, BE IT ORDAINED, BY THE CITY COUNCIL OF THE CITY OF DECATUR, ILLINOIS: Section 1. That Chapter 38 of the City Code of Decatur, Illinois,be, and the same is hereby modified and amended by adding and deleting language to Section 23. Said Section 23 as so modified, amended and added, shall provide as follows: 27. STORMWATER UTILITY AND STORMWATER FUND (E) RATES 1. Single-Family Residential propertX: Owners of developed single family residential properties, one(1) acre or less in gross area, shall be required to pay for stormwater services according to the following formula: Monthly Charge=Base Fee +Usage Fee (Usage Fee = 1 ERU x ERU Rate) 2.
