PROJECT MANUAL PAGE 12 <br /> 042 FAIR EMPLOYMENT PRACTICES <br /> The contractor and all sub-contractors hereunder must comply with the provisions of the Illinois <br /> Human Rights Commission's Rules and Regulations for public contracts and the Equal <br /> Employment Opportunity Clause attached hereto and marked "Exhibit A". <br /> 043 LICENSES&PERMITS <br /> It shall be the responsibility of the successful bidder to obtain at no additional cost to the City of <br /> Decatur any and all licenses and permits required to complete this bid.These licenses and <br /> permits shall be readily available for review by the Purchasing Supervisor or designated <br /> representative. <br /> 044 SAMPLES <br /> [RESERVED] This provision is not applicable for this project. <br /> 045 RETURN OF MATERIALS <br /> [RESERVED] This provision is not applicable for this project. <br /> 046 LIQUIDATED DAMAGE CLAUSE <br /> [RESERVED]This provision is not applicable for this project. <br /> 047 BID BONDS/DEPOSITS <br /> Each bid must be accompanied by a bid bond or deposit amounting to five percent(5%) of the <br /> total bid. Bid deposits are in the form of a Bank Cashier's Check, Certified Check, or Bid Bond <br /> made payable to the City of Decatur. Unsuccessful bidders will have their deposits returned <br /> within ten (10)days, after either the con-tract is awarded or the purchase order is accepted by <br /> the successful bidder. If the successful bidder fails to deliver as indicated in the Invitation to Bid, <br /> does not enter into the contract or fails to accept the purchase order,the City of Decatur shall <br /> be entitled to retain the deposit to rectify the bidder's unacceptable performance. In other <br /> words,the bid deposit will be forfeited to the City. <br /> 048 PERFORMANCE BOND <br /> The successful bidder shall furnish an annual performance bond in connection with the contract <br /> to protect the City of Decatur from loss due to the bidder's inability to complete the agreed <br /> upon contract annually. Performance bonds are equal to one hundred percent(100%) of the <br /> total amount of the bids for each year of the contract. Performance bonds will be forfeited to <br /> the City of Decatur should the successful bidder fail to comply with the terms and conditions <br /> COD 2023-26A AEX 6541 <br />
