receiving party shall establish and enforce the same restrictions in a like manner <br /> for water furnished from the receiving system during said period. <br /> 10. The Village or City may terminate the furnishing of water for nonpayment <br /> of water charges. Except for nonpayment of water charges, and except as may be <br /> otherwise provided by applicable law, termination shall not be available as a <br /> remedy to enforce the provisions of this Agreement, but the parties hereto may <br /> resort to action for damages or other appropriate relief to enforce the same or to <br /> correct, or obtain restitution for injury occasioned by, violation of the provisions <br /> hereof. In the event a violation is claimed, the claiming party shall give notice in <br /> writing thereof to the other party, which party shall be given a reasonable time in <br /> light of the nature of the violation claimed to correct the same, which time shall be <br /> no less than ten (10) days from the date of notice. Provided, however, that any <br /> violation resultant upon a cause maieure shall not subject either party to liability <br /> hereunder. <br /> 11. That the provisions of this Agreement are expressly made subject to the <br /> provisions and covenants of any currently outstanding water revenue bond issues <br /> or State Revolving Loan terms of either party, and the provisions hereof shall be so <br /> construed as to be compatible with and to conform thereto. <br /> 12. In the event that the furnishing of water to either party is interrupted or <br /> interfered with or infringed upon for whatever reason or by whatever cause, except <br /> the negligence of the agents or employees of either party, both parties do hereby <br /> release and shall indemnify and hold harmless, the other party from any and all <br /> liability or responsibility for the same. <br /> 13. Except as expressly provided in Section 5. hereof, all other notices in <br />
