REAL ESTATE PURCHASE AGREEMENT <br /> THIS AGREEMENT ("Agreement") is entered into by and between Andrew R. <br /> Weatherford and Josie D.Luedke("Owner")and the City of Decatur,Illinois,an Illinois municipal <br /> corporation("City"). <br /> RECITALS <br /> WHEREAS,The City is a municipal corporation as set forth in the Illinois Municipal Code, <br /> 65 ILCS 511-1-1, et. seq.; and, <br /> WHEREAS, The City is a home rule unit under Article VII Section 6(a) of the Illinois <br /> Constitution(IL Const. 1970,Art. VII, Sec. 6(a)); and, <br /> WHEREAS,Chapter 33 of the City Code of the City of Decatur provides that the City may <br /> acquire property and dispose of property as the City Council authorizes or approves; and, <br /> WHEREAS, the Owner owns property located at 412 S.Franklin St.,Decatur,Illinois that <br /> it desires to transfer to City under the terms of this Agreement. <br /> NOW,THEREFORE,in consideration of the foregoing recitals,the mutual covenants and <br /> agreements hereinafter set forth, and for good and valuable consideration,the receipt, sufficiency <br /> and adequacy of <br /> which are hereby acknowledged,the parties agree as follows: <br /> Section 1. The foregoing recitals are incorporated herein as fully stated as a part of this <br /> Agreement. <br /> Section 2. Subject to the terms and conditions of this Agreement,Owners shall transfer to <br /> the City the property located at 412 S.Franklin,Decatur,Illinois("Property")and legally described <br /> as: <br /> Lot Three (3) in Block Nine (9) of South Addition to the City of Decatur, as per Plat <br /> recorded in Book"G",Page 553 of the records in the Recorder's Office of Macon County, <br /> Illinois,also commencing at the Southwest corner of said Lot 3 in Block 9 of said Addition, <br /> thence East 110 feet,thence South 20 feet,thence West 110 feet,thence North to the place <br /> of beginning. (Except coal and other minerals underlying the surface of said land and all <br /> rights and easements in favor of the estate of said coal and other minerals). Situated in <br /> Macon County, Illinois. <br /> AND <br />
