Section 2.This Agreement shall begin on the Effective Date for a term of three <br /> (3)years. <br /> Section 3. As an express condition of this Agreement and the issuance of a Class <br /> G liquor license and Class V video gaming license,the Licensee shall remain in <br /> compliance with all municipal ordinances including,but not limited to those relating to <br /> liquor,property development,property condition,zoning,subdivision and building codes <br /> (collectively,the"City Codes").In addition to all other remedies available to the City <br /> including fines,suspensions or revocations of licensee's liquor license and video gaming <br /> license,failure to comply with all municipal ordinances shall be cause for the City to <br /> declare the Licensee in Default and terminate this Agreement. <br /> Section 4. Each signator to this Agreement warrants and represents that they are <br /> duly authorized to execute this Agreement on behalf of the party for who the Agreement <br /> is signed. <br /> Section 5.The Parties acknowledge that the Licensee does not own the building in <br /> which the licensed premises are located but leases a suite located at 3645 US-36, <br /> Decatur,IL 62521,("Premises")while the Chevrolet Hall of Fame Museum operates in <br /> another suite of the same building located at 3635 US-36,Decatur,IL 62521 under <br /> separate ownership and management than the Licensee. <br /> Section 6. As an express condition of the entering into of this Agreement for the <br /> purpose of obtaining a Class V license under the terms and conditions of the City Code of <br /> Decatur, Licensee agrees to: <br /> a.Increase the number of employees of Licensee over the term of this <br /> Agreement by five(5)part-time employees effective November 15,2024,for a <br /> total employment of fifteen(15)employees and maintain that number of <br /> employees or the full time equivalent for the term of this Agreement. <br /> b. Provide or pay for food manager's licenses for those established <br /> employees with employment positions relevant to the license. <br /> c. Hold a minimum of fifty(50)regionally advertised Amateur Pool <br /> Tournaments per year at Premises for the term of this Agreement.For purposes of <br /> this Agreement,regionally shall be defined as Central Illinois counties including <br /> Moultrie,Champaign,Coles,Vermillion,Sangamon,Piatt,Peoria,Dewitt and <br /> McClean counties. <br /> d. Increase the annual food and beverage taxes payable to the City by <br /> three percent(3%)from those due and owing from the twelve(12)months prior <br /> to the Effective Date of this Agreement for the first year of this Agreement and a <br /> like amount for the remaining two(2)years of this Agreement for a total increase <br /> of nine percent(9%)of the food and beverage taxes due and owing to the City. <br />
