e. Maintain a minimum of Ten Thousand(10,000)square feet of space for <br /> the licensed Premises. <br /> f. Install new business signage on the licensed Premises within twelve <br /> (12)months of the Effective Date of this Agreement in conformance with all <br /> applicable ordinances and codes of the City. <br /> g.Increase dining room capacity of Licensee on the licensed Premises by <br /> fifty percent(50%)within twelve(12)months of the Effective Date of this <br /> Agreement. <br /> h. Invest no less than Two Hundred Fifty Thousand Dollars($250,000) <br /> into Premises during the term of this Agreement,which investment may include <br /> those monies invested by Licensee or invested by the owner of the Licensed <br /> Premises specifically for improvements or maintenance of the Licensed Premises <br /> but shall not include any monies used for Licensee's obtaining of its Class G <br /> liquor license. <br /> i.Agree to partner with or attempt to partner with existing culinary <br /> training and/or educational programs located in the City in order to provide <br /> additional educational and training experience to residents. <br /> Section 7. As an express condition and in consideration for the Licensee's <br /> agreements set forth above and in anticipation of completion of those,the City agrees to <br /> issue a Class V liquor license,conditioned upon proof from Licensee of compliance with <br /> the agreements set forth above.Proof of compliance for the agreements set forth above <br /> shall be provided by Licensee to City under the conditions set forth in this Agreement for <br /> the term of this Agreement. <br /> Section 8. It shall be the sole responsibility of the Licensee to submit paid <br /> invoices,receipts,sign-up sheets,payroll records or other documentation("Improvement <br /> Receipts")sufficient to satisfy the City on no less than an annual basis or upon <br /> reasonable request by the City for such records necessary to determine and ensure <br /> compliance with this Agreement in order to maintain conditional approval of the Class V <br /> license.The failure of Licensee to comply with the provisions of any federal,state or <br /> local law,statute or ordinance or failure to comply with the provisions of this Agreement, <br /> including,but not limited to providing any information required or requested herein after <br /> written notice from the City,and the continued failure to provide such information within <br /> thirty(30)days after such notice,shall individually and collectively all be considered a <br /> material breach of this Agreement,and shall be cause for the City to suspend or revoke <br /> licensing hereunder to the Licensee,in addition to any other penalties and remedies <br /> available to the City for the violations. <br /> Section 9. For this Agreement,time is of the essence. <br />
